77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting the recognition, service, and enforcement
1010 of extreme risk protective orders; creating a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. This Act shall be known as the "Anti-Red Flag
1313 Act."
1414 SECTION 2. Title 1, Code of Criminal Procedure, is amended
1515 by adding Chapter 7C to read as follows:
1616 CHAPTER 7C. PROHIBITION ON RECOGNITION, SERVICE, AND ENFORCEMENT OF
1717 EXTREME RISK PROTECTIVE ORDERS
1818 Art. 7C.001. DEFINITIONS. In this chapter:
1919 (1) "Extreme risk protective order" means a written
2020 order, warrant, or executive order issued by a court or signed by a
2121 magistrate or other court officer that:
2222 (A) has the primary purpose of reducing the risk
2323 of death or injury related to a firearm by:
2424 (i) prohibiting a person from owning,
2525 possessing, or receiving a firearm; or
2626 (ii) requiring a person to surrender a
2727 firearm or otherwise removing a firearm from a person; and
2828 (B) is not issued on the basis of conduct that
2929 resulted in a criminal charge for the person who is the subject of
3030 the order.
3131 (2) "Firearm" has the meaning assigned by Section
3232 46.01, Penal Code.
3333 Art. 7C.002. LOCAL REGULATION PROHIBITED. (a) This
3434 article applies to:
3535 (1) the State of Texas, including an agency,
3636 department, commission, bureau, board, office, council, court, or
3737 other entity that is in any branch of state government and that is
3838 created by the constitution or a statute of this state, including a
3939 university system or a system of higher education;
4040 (2) the governing body of a municipality, county, or
4141 special district or authority;
4242 (3) an officer, employee, or other body that is part of
4343 a municipality, county, or special district or authority, including
4444 a sheriff, municipal police department, municipal attorney, or
4545 county attorney; and
4646 (4) a district attorney or criminal district attorney.
4747 (b) An entity described by Subsection (a) may not adopt or
4848 enforce a rule, ordinance, order, policy, or other similar measure
4949 relating to an extreme risk protective order unless state law
5050 specifically authorizes the adoption and enforcement of such a
5151 rule, ordinance, order, policy, or measure.
5252 Art. 7C.003. CERTAIN FEDERAL LAWS UNENFORCEABLE. A federal
5353 statute, order, rule, or regulation purporting to implement or
5454 enforce an extreme risk protective order against a person in this
5555 state that infringes on the person's right of due process, keeping
5656 and bearing arms, or free speech protected by the United States
5757 Constitution or the Texas Constitution is unenforceable as against
5858 the public policy of this state and shall have no effect.
5959 Art. 7C.004. ACCEPTING CERTAIN FEDERAL GRANTS PROHIBITED.
6060 An entity described by Article 7C.002(a) may not accept federal
6161 grant funds for the implementation, service, or enforcement of a
6262 federal statute, order, rule, or regulation purporting to implement
6363 or enforce an extreme risk protective order against a person in this
6464 state.
6565 Art. 7C.005. OFFENSE. (a) A person commits an offense if
6666 the person serves or enforces or attempts to serve or enforce an
6767 extreme risk protective order against a person in this state,
6868 unless the order was issued under the laws of this state.
6969 (b) An offense under this article is a state jail felony.
7070 SECTION 3. This Act takes effect September 1, 2025.
