88 AN ACT
99 relating to a matching grant program for technological enhancements
1010 at hospitals providing mental health care services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 547, Government Code, as effective April
1313 1, 2025, is amended by adding Subchapter K to read as follows:
1414 SUBCHAPTER K. MATCHING GRANT PROGRAM FOR TECHNOLOGICAL
1515 ENHANCEMENTS AT HOSPITALS PROVIDING MENTAL HEALTH CARE SERVICES
1616 Sec. 547.0501. APPLICABILITY. This subchapter applies only
1717 to:
1818 (1) a hospital licensed under Chapter 241, Health and
1919 Safety Code; or
2020 (2) a hospital licensed under Chapter 577, Health and
2121 Safety Code.
2222 Sec. 547.0502. ESTABLISHMENT OF MATCHING GRANT PROGRAM.
2323 The commission shall establish a matching grant program to enhance
2424 the technological capabilities of hospitals providing mental
2525 health care services in this state.
2626 Sec. 547.0503. ELIGIBILITY FOR GRANT AWARD. To be eligible
2727 for a grant under this subchapter, a hospital must:
2828 (1) demonstrate the hospital's planned uses for the
2929 grant money and matching funds to improve the quality of and access
3030 to mental health care services in this state;
3131 (2) align with the interoperability and technology
3232 standards in the 21st Century Cures Act (Pub. L. No. 114-255); and
3333 (3) meet any additional eligibility criteria the
3434 commission establishes.
3535 Sec. 547.0504. HOSPITAL MATCHING REQUIREMENT. (a) The
3636 commission shall condition each grant provided to a hospital under
3737 this subchapter on the hospital providing funds from non-state
3838 sources in an amount equal to 25 percent of the grant amount.
3939 (b) To raise the required non-state sourced funds, the
4040 hospital may seek and receive gifts, grants, or donations from any
4141 person.
4242 Sec. 547.0505. ACCEPTABLE USES OF GRANT MONEY AND MATCHING
4343 FUNDS. A hospital awarded a grant under this subchapter may use the
4444 grant money and matching funds to:
4545 (1) purchase a data recording platform for certified
4646 electronic health data;
4747 (2) expand the interoperability of health information
4848 in the hospital or as part of a network with other health care
4949 providers;
5050 (3) expand a patient's access to the patient's digital
5151 health records and mental health care services;
5252 (4) improve information technology infrastructure for
5353 data privacy and patient information security, including consent
5454 management; and
5555 (5) improve the efficiency of mental health care
5656 service provision through the use and interconnectivity of mobile
5757 devices.
5858 Sec. 547.0506. GIFTS, GRANTS, AND DONATIONS. The
5959 commission may solicit and accept gifts, grants, and donations from
6060 any source to award grants under this subchapter.
6161 Sec. 547.0507. BIENNIAL REPORT. Not later than December 1
6262 of each even-numbered year, the commission shall submit a report to
6363 the legislature regarding the results of the matching grant program
6464 administered under this subchapter.
6565 Sec. 547.0508. RULES. The commission may adopt any rules
6666 necessary to implement this subchapter.
6767 SECTION 2. This Act takes effect September 1, 2025.
