6	8		AN ACT
7	9		relating to the authority of a local authority to install a
8	10		temporary traffic-control device on certain highways.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Section 544.002, Transportation Code, is amended
11	13		by amending Subsection (c) and adding Subsection (d) to read as
12	14		follows:
13	15		(c) A local authority may not place or maintain a
14	16		traffic-control device on a highway under the jurisdiction of the
15	17		Texas Department of Transportation without that department's
16	18		permission, except as authorized under Subsection (d) and Section
17	19		545.3561.
18	20		(d) A local authority may place and maintain a temporary
19	21		traffic-control device on a highway under the jurisdiction of the
20	22		Texas Department of Transportation without the department's
21	23		permission if:
22	24		(1) an existing traffic-control device on the highway
23	25		becomes inoperable;
24	26		(2) the local authority notifies the department of the
25	27		placement of the temporary traffic-control device; and
26	28		(3) the local authority removes the temporary
27	29		traffic-control device as soon as practicable after the existing
28	30		traffic-control device becomes operable again.
29	31		SECTION 2. Section 553.002(d), Transportation Code, is
30	32		amended to read as follows:
31	33		(d) This section does not apply to:
32	34		(1) an ordinance enacted or a temporary speed limit
33	35		sign erected or operated under Section 545.3561; or
34	36		(2) an ordinance enacted or a temporary
35	37		traffic-control device placed or maintained under Section
36	38		544.002(d).
37	39		SECTION 3. This Act takes effect September 1, 2025.
