57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to the authority of a local authority to install a
810 temporary traffic-control device on certain highways.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 544.002, Transportation Code, is amended
1113 by amending Subsection (c) and adding Subsection (d) to read as
1214 follows:
1315 (c) A local authority may not place or maintain a
1416 traffic-control device on a highway under the jurisdiction of the
1517 Texas Department of Transportation without that department's
1618 permission, except as authorized under Subsection (d) and Section
1719 545.3561.
1820 (d) A local authority may place and maintain a temporary
1921 traffic-control device on a highway under the jurisdiction of the
2022 Texas Department of Transportation without the department's
2123 permission if:
2224 (1) an existing traffic-control device on the highway
2325 becomes inoperable;
2426 (2) the local authority notifies the department of the
2527 placement of the temporary traffic-control device; and
2628 (3) the local authority removes the temporary
2729 traffic-control device as soon as practicable after the existing
2830 traffic-control device becomes operable again.
2931 SECTION 2. Section 553.002(d), Transportation Code, is
3032 amended to read as follows:
3133 (d) This section does not apply to:
3234 (1) an ordinance enacted or a temporary speed limit
3335 sign erected or operated under Section 545.3561; or
3436 (2) an ordinance enacted or a temporary
3537 traffic-control device placed or maintained under Section
3638 544.002(d).
3739 SECTION 3. This Act takes effect September 1, 2025.
