66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the penalties for the offense of passing certain
99 vehicles, creating a criminal offense, increasing a criminal
1010 penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. This Act shall be known as the Kevin Alexis
1313 Ramirez Vasquez Act.
1414 SECTION 2. Section 521.292(a), Transportation Code, is
1515 amended to read as follows:
1616 (a) Except as provided by Section 521.457(h), the
1717 department shall suspend the person's license if the department
1818 determines that the person:
1919 (1) has operated a motor vehicle on a highway while the
2020 person's license was suspended, canceled, disqualified, or
2121 revoked, or without a license after an application for a license was
2222 denied;
2323 (2) is a habitually reckless or negligent operator of
2424 a motor vehicle;
2525 (3) is a habitual violator of the traffic laws;
2626 (4) has permitted the unlawful or fraudulent use of
2727 the person's license;
2828 (5) has committed an offense in another state or
2929 Canadian province that, if committed in this state, would be
3030 grounds for suspension;
3131 (6) has been convicted of two or more separate
3232 offenses of a violation of a restriction imposed on the use of the
3333 license;
3434 (7) has been responsible as a driver for any collision
3535 resulting in serious personal injury or serious property damage;
3636 (8) is under 18 years of age and has been convicted of
3737 two or more moving violations committed within a 12-month period;
3838 or
3939 (9) has committed an offense under Sections
4040 545.157(c)(1), (c)(2), (c)(3), or 545.421.
4141 SECTION 3. Section 545.157(c), Transportation Code, is
4242 amended to read as follows:
4343 (c) A person who violates this section commits an offense.
4444 An offense under this section is a misdemeanor punishable by a fine
4545 of not less than $500 or more than $1,250, except that the offense
4646 is:
4747 (1) a misdemeanor punishable by a fine of not less than
4848 $1,000 or more than $2,000 for a second or subsequent offense
4949 committed within five years of the date on which the most recent
5050 preceding offense was committed;
5151 (2) a Class A misdemeanor if the offense results in a
5252 collision [bodily injury to another]; or
5353 (3) a state jail felony for a second or subsequent
5454 offense punishable under Subdivision (2) or an offense resulting in
5555 bodily injury to another.
5656 SECTION 4. The change in law made by this Act applies only
5757 to an offense committed on or after the effective date of this Act.
5858 An offense committed before the effective date of this Act is
5959 governed by the law in effect on the date the offense was committed,
6060 and the former law is continued in effect for that purpose. For
6161 purposes of this section, an offense was committed before the
6262 effective date of this Act if any element of the offense occurred
6363 before that date.
6464 SECTION 5. This Act takes effect September 1, 2025.
