77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the transfer of certain public school students who are
1010 children of peace officers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 25.0344, Education Code, as added by
1313 Chapter 322 (H.B. 1959), Acts of the 88th Legislature, Regular
1414 Session, 2023, is amended by amending Subsection (b) and adding
1515 Subsections (e) and (f) to read as follows:
1616 (b) On request of a peace officer who is a parent of or
1717 person standing in parental relation to a student, the board of
1818 trustees of a school district or the board's designee shall
1919 transfer the student to:
2020 (1) another district campus; or
2121 (2) any other [to another] school district in this
2222 state, regardless of whether the sending district and the receiving
2323 district have entered into [under] an agreement under Section
2424 25.035.
2525 (e) Notwithstanding any other law, a school district must
2626 approve a transfer under this section unless the district or the
2727 district campus to which the student seeks to transfer is at full
2828 student capacity or has more requests for transfers than available
2929 positions.
3030 (f) A school district may not charge a tuition fee under
3131 Section 25.038 to a student who transfers to the district under this
3232 section.
3333 SECTION 2. This Act applies beginning with the 2025-2026
3434 school year.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2025.
