| 9 | 9 | | relating to the transfer of certain public school students who are |

| 10 | 10 | | children of peace officers. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 25.0344, Education Code, as added by |
|---|
| 13 | 13 | | Chapter 322 (H.B. 1959), Acts of the 88th Legislature, Regular |
|---|
| 14 | 14 | | Session, 2023, is amended by amending Subsection (b) and adding |
|---|
| 15 | 15 | | Subsections (e) and (f) to read as follows: |
|---|
| 16 | 16 | | (b) On request of a peace officer who is a parent of or |
|---|
| 17 | 17 | | person standing in parental relation to a student, the board of |
|---|
| 18 | 18 | | trustees of a school district or the board's designee shall |
|---|
| 19 | 19 | | transfer the student to: |
|---|
| 20 | 20 | | (1) another district campus; or |
|---|
| 21 | 21 | | (2) any other [to another] school district in this |
|---|
| 22 | 22 | | state, regardless of whether the sending district and the receiving |
|---|
| 23 | 23 | | district have entered into [under] an agreement under Section |
|---|
| 24 | 24 | | 25.035. |
|---|
| 25 | 25 | | (e) Notwithstanding any other law, a school district must |
|---|
| 26 | 26 | | approve a transfer under this section unless the district or the |
|---|
| 27 | 27 | | district campus to which the student seeks to transfer is at full |
|---|
| 28 | 28 | | student capacity or has more requests for transfers than available |
|---|
| 29 | 29 | | positions. |
|---|
| 30 | 30 | | (f) A school district may not charge a tuition fee under |
|---|
| 31 | 31 | | Section 25.038 to a student who transfers to the district under this |
|---|
| 32 | 32 | | section. |
|---|
| 33 | 33 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 34 | 34 | | school year. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2025. |
