11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 773.0145, Health and Safety Code, is | |
13 | 13 | amended by adding Subsection (a-1) and amending Subsection (c) to | |
14 | 14 | read as follows: | |
15 | 15 | (a-1) This section does not apply to an entity that is | |
16 | 16 | required by another law to adopt and implement a policy governing | |
17 | 17 | the maintenance, administration, and disposal of epinephrine | |
18 | 18 | auto-injectors by the entity. | |
19 | 19 | (c) An entity in this state, including a governmental | |
20 | 20 | entity, [described by Subsection (a)] may adopt a policy regarding | |
21 | 21 | the maintenance, administration, and disposal of epinephrine | |
22 | 22 | auto-injectors. | |
23 | 23 | SECTION 2. Sections 773.0145(a) and (b), Health and Safety | |
24 | 24 | Code, are repealed. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2025. |
