77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the possession and administration of an epinephrine
1010 auto-injector by certain entities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 773.0145, Health and Safety Code, is
1313 amended by adding Subsection (a-1) and amending Subsection (c) to
1414 read as follows:
1515 (a-1) This section does not apply to an entity that is
1616 required by another law to adopt and implement a policy governing
1717 the maintenance, administration, and disposal of epinephrine
1818 auto-injectors by the entity.
1919 (c) An entity in this state, including a governmental
2020 entity, [described by Subsection (a)] may adopt a policy regarding
2121 the maintenance, administration, and disposal of epinephrine
2222 auto-injectors.
2323 SECTION 2. Sections 773.0145(a) and (b), Health and Safety
2424 Code, are repealed.
2525 SECTION 3. This Act takes effect September 1, 2025.
