77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of social workers for the Homes for
1010 Texas Heroes home loan program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2306.5621(a), Government Code, is
1313 amended by amending Subdivision (2) and adding Subdivision (15-a)
1414 to read as follows:
1515 (2) "Home" means a dwelling in this state in which a
1616 fire fighter, corrections officer, county jailer, public security
1717 officer, peace officer, professional educator, social worker,
1818 veteran, or person defined as emergency medical services personnel
1919 under this section intends to reside as the borrower's principal
2020 residence.
2121 (15-a) "Social worker" has the meaning assigned by
2222 Section 505.002, Occupations Code.
2323 SECTION 2. Sections 2306.5621(b), (c), (d), (f), and (h-1),
2424 Government Code, are amended to read as follows:
2525 (b) The corporation shall establish a program to provide
2626 eligible fire fighters, corrections officers, county jailers,
2727 public security officers, peace officers, emergency medical
2828 services personnel, professional educators, social workers, and
2929 veterans with low-interest home mortgage loans.
3030 (c) To be eligible for a loan under this section, at the time
3131 a person files an application for the loan, the person must:
3232 (1) be a:
3333 (A) fire fighter, corrections officer, county
3434 jailer, public security officer, peace officer, social worker,
3535 veteran, or person defined as emergency medical services personnel
3636 under this section; or
3737 (B) professional educator who is employed by a
3838 school district or is an allied health or professional nursing
3939 program faculty member in this state;
4040 (2) reside in this state; and
4141 (3) have an income of not more than 115 percent of area
4242 median family income, adjusted for family size, or the maximum
4343 amount permitted by Section 143(f), Internal Revenue Code of 1986,
4444 whichever is greater.
4545 (d) The corporation may contract with other agencies of the
4646 state or with private entities to determine whether applicants
4747 qualify as fire fighters, corrections officers, county jailers,
4848 public security officers, peace officers, emergency medical
4949 services personnel, professional educators, social workers, or
5050 veterans under this section or otherwise to administer all or part
5151 of this section.
5252 (f) The board of directors of the corporation shall adopt
5353 rules governing:
5454 (1) the administration of the program;
5555 (2) the making of loans under the program;
5656 (3) the criteria for approving mortgage lenders;
5757 (4) the use of insurance on the loans and the homes
5858 financed under the program, as considered appropriate by the board
5959 to provide additional security for the loans;
6060 (5) the verification of occupancy of the home by the
6161 fire fighter, corrections officer, county jailer, public security
6262 officer, peace officer, professional educator, social worker,
6363 veteran, or person defined as emergency medical services personnel
6464 as the borrower's principal residence; and
6565 (6) the terms of any contract made with any mortgage
6666 lender for processing, originating, servicing, or administering
6767 the loans.
6868 (h-1) To fund home mortgage loans for eligible fire
6969 fighters, corrections officers, county jailers, public security
7070 officers, peace officers, emergency medical services personnel,
7171 professional educators, social workers, and veterans under this
7272 section, the corporation may use any proceeds received from the
7373 sale of bonds, notes, or other obligations issued under the home
7474 loan program provided by this section, regardless of any amendments
7575 to the eligibility standards for loans made under the program and
7676 regardless of when the corporation received the proceeds from those
7777 bonds, notes, or other obligations issued under the program.
7878 SECTION 3. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2025.
