97 AN ACT
108 relating to the use, possession, delivery, or manufacture of
11- testing equipment that identifies the presence of a substance
12- listed in Penalty Group 1-B or xylazine.

1312 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1413 SECTION 1. Section 481.125, Health and Safety Code, is
1514 amended by adding Subsection (j) to read as follows:
1615 (j) This section does not apply to a person who uses,
17- possesses with intent to use, delivers, possesses with intent to
18- deliver, or manufactures with intent to deliver testing equipment
19- that identifies the presence of a substance listed in Penalty Group
20- 1-B or xylazine.

2121 SECTION 2. The change in law made by this Act applies only
2222 to an offense committed on or after the effective date of this Act.
2323 An offense committed before the effective date of this Act is
2424 governed by the law in effect at the time the offense was committed,
2525 and the former law is continued in effect for that purpose. For
2626 purposes of this section, an offense was committed before the
2727 effective date of this Act if any element of the offense occurred
2828 before that date.
2929 SECTION 3. This Act takes effect September 1, 2025.
