77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of certain retired or former district
1010 court judges for assignment as a visiting judge.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 74.055, Government Code, is amended by
1313 adding Subsections (d), (f-1), and (h) to read as follows:
1414 (d) Notwithstanding Subsection (c)(4), a retired or former
1515 district court judge is eligible to be named on the list if the
1616 retired or former district court judge certifies under oath to the
1717 presiding judge, on a form prescribed by the state board of regional
1818 judges, that during the 15 years preceding assignment under this
1919 section:
2020 (1) the judge has not been publicly reprimanded or
2121 censured by the State Commission on Judicial Conduct; and
2222 (2) the judge:
2323 (A) did not resign or retire from office after
2424 the State Commission on Judicial Conduct notified the judge of the
2525 commencement of a full investigation into an allegation or
2626 appearance of misconduct or disability of the judge as provided in
2727 Section 33.022 and before the final disposition of that
2828 investigation; or
2929 (B) if the judge resigned from office under
3030 circumstances described by Paragraph (A), was not publicly
3131 reprimanded or censured as a result of the investigation.
3232 (f-1) Notwithstanding Subsection (f), a former or retired
3333 district court judge is ineligible to be named on the list only if
3434 during the 15 years preceding appointment under this section the
3535 former or retired judge is identified in a public statement issued
3636 by the State Commission on Judicial Conduct as having resigned or
3737 retired from office in lieu of discipline.
3838 (h) Subsections (d) and (f-1) and this subsection expire
3939 September 1, 2033.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2025.
