99 relating to the payment of gratuities to certain employees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 61, Labor Code, is amended
1212 by adding Section 61.021 to read as follows:
1313 Sec. 61.021. GRATUITIES PAID TO TIPPED EMPLOYEES. (a) In
1414 this section, "tipped employee" has the meaning assigned by Section
1515 62.052.
1616 (b) An employer may not collect or receive any portion of a
1717 gratuity paid to or left for a tipped employee, including for the
1818 purpose of compensating a credit or debit card issuer for any
1919 financial services rendered on account of the gratuity. The
2020 gratuity is the property of the tipped employee.
2121 SECTION 2. Section 61.021, Labor Code, as added by this Act,
2222 applies only to a gratuity paid to or left for an employee on or
2323 after the effective date of this Act.
2424 SECTION 3. This Act takes effect September 1, 2025.
