68 AN ACT
79 relating to application of the Administrative Procedure Act to
810 certain actions by the Texas Department of Motor Vehicles related
911 to the compliance review and safety audit program for commercial
1012 motor vehicles.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Section 2001.221, Government Code, is amended to
1315 read as follows:
1416 Sec. 2001.221. [DRIVER'S] LICENSES AND ORDERS RELATING TO
1517 TRANSPORTATION. This chapter does not apply to a suspension,
1618 revocation, cancellation, denial, or disqualification of a
1719 driver's license or commercial driver's license, or to an action by
1820 the Texas Department of Motor Vehicles related to an order to cease
1921 intrastate operation under the Department of Public Safety's
2022 compliance review and safety audit program for commercial motor
2123 vehicles, as authorized by:
2224 (1) Subchapter N, Chapter 521, Transportation Code,
2325 except Sections 521.304 and 521.305 of that subchapter, or by
2426 Subchapter O or P of that chapter;
2527 (2) Chapter 522, Transportation Code;
2628 (3) Chapter 601, Transportation Code;
2729 (4) Section 644.155, Transportation Code; or
2830 (5) [(4)] Article 42A.406 or 42A.407, Code of Criminal
2931 Procedure.
3032 SECTION 2. This Act takes effect immediately if it receives
3133 a vote of two-thirds of all the members elected to each house, as
3234 provided by Section 39, Article III, Texas Constitution. If this
3335 Act does not receive the vote necessary for immediate effect, this
3436 Act takes effect September 1, 2025.
