77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of school bus drivers and cafeteria
1010 workers for unemployment compensation benefits.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 207.041, Labor Code, is amended by
1313 adding Subsection (b-1) to read as follows:
1414 (b-1) Subsection (b) does not apply to an individual if the
1515 services performed by the individual for an educational institution
1616 consist only of:
1717 (1) driving a school bus transporting students to and
1818 from school or a school-sponsored or school-related activity; or
1919 (2) working as a cafeteria worker.
2020 SECTION 2. The change in law made by this Act applies only
2121 to a claim for unemployment compensation benefits filed with the
2222 Texas Workforce Commission on or after the effective date of this
2323 Act. A claim filed before the effective date of this Act is
2424 governed by the law in effect on the date the claim was filed, and
2525 the former law is continued in effect for that purpose.
2626 SECTION 3. This Act takes effect September 1, 2025.
