| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 233.061(b), Local Government Code, is | |
| 13 | 13 | amended to read as follows: | |
| 14 | 14 | (b) The commissioners court of a county that adopts a fire | |
| 15 | 15 | code under Subsection (a) [, or any municipality in the county,] may | |
| 16 | 16 | contract with a municipality located in the county or an emergency | |
| 17 | 17 | services district located wholly in the county [one another] for | |
| 18 | 18 | the administration and enforcement of the fire code. | |
| 19 | 19 | SECTION 2. Section 352.019, Local Government Code, is | |
| 20 | 20 | amended by amending Subsection (a) and adding Subsection (a-1) to | |
| 21 | 21 | read as follows: | |
| 22 | 22 | (a) Except as provided by Subsection (a-1), the [The] county | |
| 23 | 23 | fire marshal shall enforce all state and county regulations that | |
| 24 | 24 | relate to fires, explosions, or damages of any kind caused by a fire | |
| 25 | 25 | or explosion. | |
| 26 | 26 | (a-1) The county fire marshal shall delegate the | |
| 27 | 27 | administration and enforcement of the county's fire code to a | |
| 28 | 28 | municipality or emergency services district in accordance with a | |
| 29 | 29 | contract entered into by the commissioners court of the county | |
| 30 | 30 | under Section 233.061. | |
| 31 | 31 | SECTION 3. This Act takes effect September 1, 2025. |
