46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to prosecution of certain criminal offense prohibiting
79 sexually explicit visual material involving children.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 43.26, Penal Code, is amended by
1012 amending subsection (b) to read as follows:
1113 (b) In this section:
1214 (1) "Indistinguishable" means when used in respect to
1315 a visual depiction, means virtually indistinguishable, in that
1416 visual depiction is such that an ordinary person viewing the visual
1517 depiction would conclude that the visual depiction is of an actual
1618 minor engaged in a prohibited sexual act.
1719 (12) "Promote" has the meaning assigned by Section
1820 43.25.
1921 (23) "Sexual conduct" has the meaning assigned by
2022 Section 43.25.
2123 (34) "Visual material" means:
2224 (A) any film, photograph, videotape, negative,
2325 or slide or any photographic reproduction that contains or
2426 incorporates in any manner any film, photograph, videotape,
2527 negative, or slide; or
2628 (B) any disk, diskette, or other physical medium
2729 that allows an image to be displayed on a computer or other video
2830 screen and any image transmitted to a computer or other video screen
2931 by telephone line, cable, satellite transmission, or other method.
3032 SECTION 2. Section 43.26(i), Penal Code is amended to read
3133 as follows:
3234 (i) For purposes of conduct prohibited under this section,
3335 visual material to which that conduct applies includes a depiction
3436 of a child:
3537 (1) who is recognizable as an actual person by the
3638 person's face, likeness, or other distinguishing characteristic,
3739 such as a unique birthmark or other recognizable feature; and or
3840 (2) whose image as a child younger than 18 years of age
3941 was used in creating, adapting, or modifying the visual material,
4042 including computer-generated visual material that was created,
4143 adapted, or modified using an artificial intelligence application
4244 or other computer software. is indistinguishable from an actual
4345 minor created by the use of artificial intelligence or other
4446 computer technology capable of processing and interpreting
4547 specific data inputs to create a visual depiction.
4648 SECTION 3. Section 43.261, Penal Code is amended by
4749 amending Subsection (b-1) to read as follows:
4850 (b-1) For purposes of conduct prohibited under Subsection
4951 (b), visual material to which that conduct applies includes a
5052 depiction of a minor:
5153 (1) who is recognizable as an actual person by the
5254 person's face, likeness, or other distinguishing characteristic,
5355 such as a unique birthmark or other recognizable feature; and or
5456 (2) whose image as a minor was used in creating,
5557 adapting, or modifying the visual material, including
5658 computer-generated visual material that was created, adapted, or
5759 modified using an artificial intelligence application or other
5860 computer software. is indistinguishable from an actual minor
5961 created by the use of artificial intelligence or other computer
6062 technology capable of processing and interpreting specific data
6163 inputs to create a visual depiction.
6264 SECTION 4. Section 43.262, Penal Code, is amended by
6365 amending Subsection (b-1) to read as follows:
6466 (b-1) For purposes of conduct prohibited under Subsection
6567 (b), visual material to which that conduct applies includes a
6668 depiction of a child:
6769 (1) who is recognizable as an actual person by the
6870 person's face, likeness, or other distinguishing characteristic,
6971 such as a unique birthmark or other recognizable feature; andor
7072 (2) whose image as a child younger than 18 years of age
7173 was used in creating, adapting, or modifying the visual material,
7274 including computer-generated visual material that was created,
7375 adapted, or modified using an artificial intelligence application
7476 or other computer software. is indistinguishable from an actual
7577 minor created by the use of artificial intelligence or other
7678 computer technology capable of processing and interpreting
7779 specific data inputs to create a visual depiction.
7880 SECTION 5. The changes in law made by this Act apply only to
7981 an offense committed on or after the effective date of this Act. An
8082 offense committed before the effective date of this Act is governed
8183 by the law in effect on the date the offense was committed, and the
8284 former law is continued in effect for that purpose. For purposes of
8385 this section, an offense was committed before the effective date of
8486 this Act if any element of the offense was committed before that
8587 date.
8688 SECTION 6. This Act takes effect September 1, 2025.
