| 11 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 14 | | SECTION 1. Subchapter F, Chapter 203, Transportation Code, |

| 13 | 15 | | is amended by adding Section 203.113 to read as follows: |
|---|
| 14 | 16 | | Sec. 203.113. OWNER OR LESSEE ACCESS TO CERTAIN PROPERTY. |
|---|
| 15 | 17 | | (a) Notwithstanding any other law, the department may not prohibit |
|---|
| 16 | 18 | | or otherwise restrict a person from accessing property the person |
|---|
| 17 | 19 | | owns or leases that: |
|---|
| 18 | 20 | | (1) is adjacent to a highway right-of-way; |
|---|
| 19 | 21 | | (2) could be accessed legally from the roadway before |
|---|
| 20 | 22 | | the department assumed authority over the right-of-way; and |
|---|
| 21 | 23 | | (3) was acquired or constructed before the department |
|---|
| 22 | 24 | | assumed authority over the right-of-way. |
|---|
| 23 | 25 | | (b) This section does not prohibit the department or the |
|---|
| 24 | 26 | | commission from acquiring a person's interest in property described |
|---|
| 25 | 27 | | by Subsection (a) through purchase, condemnation, or other means as |
|---|
| 26 | 28 | | authorized by Subchapter D or other law. |
|---|
| 27 | 29 | | SECTION 2. This Act takes effect September 1, 2025. |
