88 AN ACT
99 relating to compensation for habilitation transportation services
1010 under the community living assistance and support services (CLASS)
1111 waiver program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 546, Government Code, as effective April
1414 1, 2025, is amended by adding Subchapter J-1 to read as follows:
1515 SUBCHAPTER J-1. COMMUNITY LIVING ASSISTANCE AND SUPPORT SERVICES
1616 (CLASS) WAIVER PROGRAM
1717 Sec. 546.0472. HABILITATION TRANSPORTATION SERVICES. To
1818 the extent permitted by federal law, an individual who provides
1919 habilitation transportation services to a recipient under the
2020 community living assistance and support services (CLASS) waiver
2121 program is entitled to compensation for all time spent operating a
2222 motor vehicle in connection with transporting a recipient,
2323 including time spent returning a recipient's vehicle to a
2424 designated location without the recipient as a passenger.
2525 SECTION 2. If before implementing any provision of this Act
2626 a state agency determines that a waiver or authorization from a
2727 federal agency is necessary for implementation of that provision,
2828 the agency affected by the provision shall request the waiver or
2929 authorization and may delay implementing that provision until the
3030 waiver or authorization is granted.
3131 SECTION 3. This Act takes effect September 1, 2025.
