12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Chapter 546, Government Code, as effective April | |
14 | 14 | 1, 2025, is amended by adding Subchapter J-1 to read as follows: | |
15 | 15 | SUBCHAPTER J-1. COMMUNITY LIVING ASSISTANCE AND SUPPORT SERVICES | |
16 | 16 | (CLASS) WAIVER PROGRAM | |
17 | 17 | Sec. 546.0472. HABILITATION TRANSPORTATION SERVICES. To | |
18 | 18 | the extent permitted by federal law, an individual who provides | |
19 | 19 | habilitation transportation services to a recipient under the | |
20 | 20 | community living assistance and support services (CLASS) waiver | |
21 | 21 | program is entitled to compensation for all time spent operating a | |
22 | 22 | motor vehicle in connection with transporting a recipient, | |
23 | 23 | including time spent returning a recipient's vehicle to a | |
24 | 24 | designated location without the recipient as a passenger. | |
25 | 25 | SECTION 2. If before implementing any provision of this Act | |
26 | 26 | a state agency determines that a waiver or authorization from a | |
27 | 27 | federal agency is necessary for implementation of that provision, | |
28 | 28 | the agency affected by the provision shall request the waiver or | |
29 | 29 | authorization and may delay implementing that provision until the | |
30 | 30 | waiver or authorization is granted. | |
31 | 31 | SECTION 3. This Act takes effect September 1, 2025. |
