46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the applicability of certain federal environmental
79 regulations to motor vehicles that are manufactured, sold, and
810 operated exclusively in this state.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Chapter 750, Transportation Code, is amended by
1113 adding Section 750.001 to read as follows:
1214 Sec. 750.001. APPLICABILITY OF CERTAIN FEDERAL
1315 ENVIRONMENTAL REGULATIONS TO MOTOR VEHICLES MANUFACTURED, SOLD,
1416 AND OPERATED EXCLUSIVELY IN TEXAS. (a) This section applies only
1517 to a motor vehicle that is manufactured, sold, and operated
1618 exclusively in this state.
1719 (b) For purposes of this section, a motor vehicle is
1820 manufactured exclusively in this state if the vehicle is
1921 manufactured without the inclusion of any parts or materials
2022 imported from another state or country other than generic and
2123 insignificant parts or materials.
2224 (c) A motor vehicle manufactured and sold exclusively in
2325 this state must have the words "Made in Texas" affixed to the motor
2426 vehicle in the manner, form, and location prescribed by the Texas
2527 Department of Motor Vehicles.
2628 (d) A motor vehicle to which this section applies is not
2729 subject to any federal regulation under the authority of the United
2830 States Congress to regulate interstate commerce that is adopted by
2931 the United States Environmental Protection Agency or a successor
3032 agency.
3133 SECTION 2. The change in law made by this Act applies only
3234 to a motor vehicle that is manufactured on or after the effective
3335 date of this Act.
3436 SECTION 3. This Act takes effect September 1, 2025.
