77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a limitation on the number of terms a person may serve
1010 as a commissioner of Port Freeport.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 5002.053, Special
1313 District Local Laws Code, is amended to read as follows:
1414 Sec. 5002.053. ELECTION BY POSITION; QUALIFICATIONS; TERM
1515 LIMITS.
1616 SECTION 2. Section 5002.053, Special District Local Laws
1717 Code, is amended by adding Subsection (c) to read as follows:
1818 (c) To be eligible to be elected as a commissioner, a person
1919 may not have previously served two or more full terms as a
2020 commissioner. The completion of the remainder of an unexpired term
2121 by a person elected or appointed to fill a vacancy does not
2222 constitute service for a full term for purposes of this subsection.
2323 SECTION 3. Section 5002.053(c), Special District Local Laws
2424 Code, as added by this Act, does not apply to a term of office that
2525 began before the effective date of this Act.
2626 SECTION 4. (a) The legal notice of the intention to
2727 introduce this Act, setting forth the general substance of this
2828 Act, has been published as provided by law, and the notice and a
2929 copy of this Act have been furnished to all persons, agencies,
3030 officials, or entities to which they are required to be furnished
3131 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3232 Government Code.
3333 (b) The governor, one of the required recipients, has
3434 submitted the notice and Act to the Texas Commission on
3535 Environmental Quality.
3636 (c) The Texas Commission on Environmental Quality has filed
3737 its recommendations relating to this Act with the governor, the
3838 lieutenant governor, and the speaker of the house of
3939 representatives within the required time.
4040 (d) All requirements of the constitution and laws of this
4141 state and the rules and procedures of the legislature with respect
4242 to the notice, introduction, and passage of this Act are fulfilled
4343 and accomplished.
4444 SECTION 5. This Act takes effect September 1, 2025.
