77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting public institutions of higher education
1010 from soliciting or accepting gifts, grants, or donations from
1111 certain foreign countries.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1414 amended by adding Section 51.984 to read as follows:
1515 Sec. 51.984. PROHIBITION ON SOLICITING OR ACCEPTING GIFTS,
1616 GRANTS, OR DONATIONS FROM CERTAIN FOREIGN COUNTRIES. (a) In this
1717 section:
1818 (1) "Foreign terrorist organization" has the meaning
1919 assigned by Section 2252.151, Government Code.
2020 (2) "Institution of higher education" has the meaning
2121 assigned by Section 61.003.
2222 (b) Notwithstanding any other law, an institution of higher
2323 education may not solicit or accept a gift, grant, or donation from:
2424 (1) a governmental entity of China, Iran, North Korea,
2525 or Russia; or
2626 (2) a governmental entity of a country that has
2727 provided material support to a foreign terrorist organization.
2828 (c) The Texas Higher Education Coordinating Board may adopt
2929 rules as necessary to implement this section.
3030 SECTION 2. This Act takes effect September 1, 2025.
