77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the transfer of court files in a suit affecting the
1010 parent-child relationship in which continuing, exclusive
1111 jurisdiction is transferred.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 155.207(a), Family Code, is amended to
1414 read as follows:
1515 (a) Not later than the 10th working day after the date an
1616 order of transfer is signed, the clerk of the court transferring a
1717 proceeding shall send, using the electronic filing system
1818 established under Section 72.031, Government Code, to the proper
1919 court to which transfer is being made:
2020 (1) a transfer certificate and index of transferred
2121 documents;
2222 (2) a copy of each final order;
2323 (3) a copy of the order of transfer signed by the
2424 transferring court;
2525 (4) a copy of the pleadings in the pending proceeding
2626 and any other document specifically requested by a party [original
2727 papers filed in the transferring court];
2828 (5) a copy of the transfer certificate and index of
2929 transferred documents from each previous transfer; and
3030 (6) a bill of any costs that have accrued in the
3131 transferring court.
3232 SECTION 2. The change in law made by this Act to Section
3333 155.207(a), Family Code, applies only to a suit affecting the
3434 parent-child relationship in which an order transferring
3535 continuing, exclusive jurisdiction to another court is rendered on
3636 or after the effective date of this Act. A suit affecting the
3737 parent-child relationship in which an order transferring
3838 continuing, exclusive jurisdiction to another court is rendered
3939 before the effective date of this Act is governed by the law in
4040 effect on the date the order was rendered, and the former law is
4141 continued in effect for that purpose.
4242 SECTION 3. This Act takes effect September 1, 2025.
