8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 211.006(d), Local Government Code, is |
---|
10 | 12 | | amended to read as follows: |
---|
11 | 13 | | (d) If a proposed change to a regulation or boundary is |
---|
12 | 14 | | protested in accordance with this subsection, the proposed change |
---|
13 | 15 | | must receive, in order to take effect, the affirmative vote of a |
---|
14 | 16 | | majority [at least three-fourths] of all members of the governing |
---|
15 | 17 | | body. The protest must be written and signed by the owners of at |
---|
16 | 18 | | least 50 [20] percent of either: |
---|
17 | 19 | | (1) the area of the lots or land covered by the |
---|
18 | 20 | | proposed change; or |
---|
19 | 21 | | (2) the area of the lots or land immediately adjoining |
---|
20 | 22 | | the area covered by the proposed change and extending 200 feet from |
---|
21 | 23 | | that area. |
---|
22 | 24 | | SECTION 2. The changes in law made by this Act apply only to |
---|
23 | 25 | | a proposal to change a municipal zoning regulation or zoning |
---|
24 | 26 | | district boundary for which notice is given on or after the |
---|
25 | 27 | | effective date of this Act. A proposal to change a municipal zoning |
---|
26 | 28 | | regulation or zoning district boundary for which notice is given |
---|
27 | 29 | | before the effective date of this Act is governed by the law in |
---|
28 | 30 | | effect on the date the notice was given, and the former law is |
---|
29 | 31 | | continued in effect for that purpose. |
---|
30 | 32 | | SECTION 3. This Act takes effect September 1, 2025. |
