46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to protesting changes to municipal zoning regulations and
79 boundaries.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 211.006(d), Local Government Code, is
1012 amended to read as follows:
1113 (d) If a proposed change to a regulation or boundary is
1214 protested in accordance with this subsection, the proposed change
1315 must receive, in order to take effect, the affirmative vote of a
1416 majority [at least three-fourths] of all members of the governing
1517 body. The protest must be written and signed by the owners of at
1618 least 50 [20] percent of either:
1719 (1) the area of the lots or land covered by the
1820 proposed change; or
1921 (2) the area of the lots or land immediately adjoining
2022 the area covered by the proposed change and extending 200 feet from
2123 that area.
2224 SECTION 2. The changes in law made by this Act apply only to
2325 a proposal to change a municipal zoning regulation or zoning
2426 district boundary for which notice is given on or after the
2527 effective date of this Act. A proposal to change a municipal zoning
2628 regulation or zoning district boundary for which notice is given
2729 before the effective date of this Act is governed by the law in
2830 effect on the date the notice was given, and the former law is
2931 continued in effect for that purpose.
3032 SECTION 3. This Act takes effect September 1, 2025.
