108 AN ACT
119 relating to the appointment of spoken language interpreters for
1210 certain court proceedings.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Section 57.002(d), Government Code, is amended
1513 to read as follows:
1614 (d) Subject to Subsection (e), in a county with a population
1715 of 50,000 or more, a court may appoint a spoken language interpreter
1816 who is not a certified or licensed court interpreter:
1917 (1) if:
2018 (A) [(1)] the language necessary in the
2119 proceeding is a language other than Spanish; and
2220 (B) [(2)] the court makes a finding that there is
2321 no licensed court interpreter within 75 miles who can interpret in
2422 the language that is necessary in a proceeding; or
2523 (2) if the court is a justice court, municipal court,
26- or municipal court of record conducting a Class C misdemeanor case
27- proceeding other than a jury trial.
