13 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
14 | 12 | SECTION 1. Section 57.002(d), Government Code, is amended | |
15 | 13 | to read as follows: | |
16 | 14 | (d) Subject to Subsection (e), in a county with a population | |
17 | 15 | of 50,000 or more, a court may appoint a spoken language interpreter | |
18 | 16 | who is not a certified or licensed court interpreter: | |
19 | 17 | (1) if: | |
20 | 18 | (A) [(1)] the language necessary in the | |
21 | 19 | proceeding is a language other than Spanish; and | |
22 | 20 | (B) [(2)] the court makes a finding that there is | |
23 | 21 | no licensed court interpreter within 75 miles who can interpret in | |
24 | 22 | the language that is necessary in a proceeding; or | |
25 | 23 | (2) if the court is a justice court, municipal court, | |
26 | - | or municipal court of record conducting a Class C misdemeanor case | |
27 | - | proceeding other than a jury trial. | |
