88 AN ACT
99 relating to the minimum duration of certain protective orders.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 7B.007(a), Code of Criminal Procedure,
1212 is amended to read as follows:
1313 (a) A protective order issued under Article 7B.003 may be
1414 effective for the duration of the lives of the offender and victim
1515 or for a [any shorter] period of not less than one year stated in the
1616 order. If a period is not stated in the order, the order is
1717 effective until the second anniversary of the date the order was
1818 issued.
1919 SECTION 2. Section 85.025(a), Family Code, is amended to
2020 read as follows:
2121 (a) Except as otherwise provided by this section, an order
2222 under this subtitle is effective:
2323 (1) for a [the] period of not less than one year and
2424 not more than two years stated in the order [, not to exceed two
2525 years]; or
2626 (2) if a period is not stated in the order, until the
2727 second anniversary of the date the order was issued.
2828 SECTION 3. The change in law made by this Act applies only
2929 to a protective order rendered on or after the effective date of
3030 this Act. A protective order rendered before the effective date of
3131 this Act is governed by the law in effect on the date the order was
3232 rendered, and the former law is continued in effect for that
3333 purpose.
3434 SECTION 4. This Act takes effect September 1, 2025.
