| 9 | 9 | | relating to the duties of a public school counselor. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 33.006(a) and (b), Education Code, are |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (a) The primary responsibility of a school counselor is to |
|---|
| 14 | 14 | | counsel students to fully develop each student's academic, career, |
|---|
| 15 | 15 | | personal, [and] social, and emotional abilities. |
|---|
| 16 | 16 | | (b) In addition to a school counselor's responsibility |
|---|
| 17 | 17 | | under Subsection (a), the school counselor shall: |
|---|
| 18 | 18 | | (1) participate in planning, implementing, and |
|---|
| 19 | 19 | | evaluating a comprehensive developmental school counseling |
|---|
| 20 | 20 | | [guidance] program to serve all students and to address the special |
|---|
| 21 | 21 | | needs of students: |
|---|
| 22 | 22 | | (A) who are at risk of dropping out of school, |
|---|
| 23 | 23 | | becoming substance abusers, participating in gang activity, or |
|---|
| 24 | 24 | | committing suicide; |
|---|
| 25 | 25 | | (B) who are at risk of: |
|---|
| 26 | 26 | | (i) choosing an unhealthy or inappropriate |
|---|
| 27 | 27 | | solution to a problem; or |
|---|
| 28 | 28 | | (ii) engaging in harmful behavior toward |
|---|
| 29 | 29 | | themselves or others; |
|---|
| 30 | 30 | | (C) who are in need of modified instructional |
|---|
| 31 | 31 | | strategies; or |
|---|
| 32 | 32 | | (D) [(C)] who are gifted and talented, with |
|---|
| 33 | 33 | | emphasis on identifying and serving gifted and talented students |
|---|
| 34 | 34 | | who are educationally disadvantaged; |
|---|
| 35 | 35 | | (2) consult with a student's parent or guardian and |
|---|
| 36 | 36 | | make referrals as appropriate in consultation with the student's |
|---|
| 37 | 37 | | parent or guardian; |
|---|
| 38 | 38 | | (3) consult with school staff, parents, and other |
|---|
| 39 | 39 | | community members to help them increase the effectiveness of |
|---|
| 40 | 40 | | student education and promote student success; |
|---|
| 41 | 41 | | (4) coordinate people and resources in the school, |
|---|
| 42 | 42 | | home, and community; |
|---|
| 43 | 43 | | (5) with the assistance of school staff, interpret |
|---|
| 44 | 44 | | standardized test results and other assessment data that help a |
|---|
| 45 | 45 | | student make educational and career plans; |
|---|
| 46 | 46 | | (6) deliver classroom guidance activities or serve as |
|---|
| 47 | 47 | | a consultant to teachers conducting lessons based on the school's |
|---|
| 48 | 48 | | guidance curriculum; and |
|---|
| 49 | 49 | | (7) serve as an impartial, nonreporting resource for |
|---|
| 50 | 50 | | interpersonal conflicts and discord involving two or more students, |
|---|
| 51 | 51 | | including accusations of bullying under Section 37.0832. |
|---|
| 52 | 52 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 53 | 53 | | school year. |
|---|
| 54 | 54 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 55 | 55 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 56 | 56 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 57 | 57 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 58 | 58 | | Act takes effect September 1, 2025. |
|---|
