9 | 9 | | relating to the construction, expansion, or modification of certain |
---|
10 | 10 | | concrete plants under a standard permit. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 382.05195, Health and Safety Code, is |
---|
13 | 13 | | amended by adding Subsection (f-1) and amending Subsection (k) to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (f-1) This subsection applies only to a standard permit |
---|
16 | 16 | | issued under this section that authorizes the operation of a |
---|
17 | 17 | | concrete plant that performs wet batching, dry batching, or central |
---|
18 | 18 | | mixing, including a permanent, temporary, or specialty concrete |
---|
19 | 19 | | batch plant, as defined by the commission. If the commission amends |
---|
20 | 20 | | the standard permit, the commission may require each facility |
---|
21 | 21 | | operator authorized to begin new construction, expansion, or |
---|
22 | 22 | | modification of a facility under the former standard permit to |
---|
23 | 23 | | update the facility's plans for the new construction, expansion, or |
---|
24 | 24 | | modification in accordance with the amended standard permit if the |
---|
25 | 25 | | facility operator did not begin the construction, expansion, or |
---|
26 | 26 | | modification before the adoption of the amended permit. |
---|
27 | 27 | | (k) An application for an authorization to use [the issuance |
---|
28 | 28 | | of] a standard permit issued under this section for a concrete plant |
---|
29 | 29 | | that performs wet batching, dry batching, or central mixing, |
---|
30 | 30 | | including a permanent, temporary, or specialty concrete batch |
---|
31 | 31 | | plant, as defined by the commission, must include a plot plan that |
---|
32 | 32 | | clearly shows: |
---|
33 | 33 | | (1) a distance scale; |
---|
34 | 34 | | (2) a north arrow; |
---|
35 | 35 | | (3) all property lines, emission points, buildings, |
---|
36 | 36 | | tanks, and process vessels and other process equipment in the area |
---|
37 | 37 | | in which the facility will be located; |
---|
38 | 38 | | (4) at least two benchmark locations in the area in |
---|
39 | 39 | | which the facility will be located; and |
---|
40 | 40 | | (5) if the permit requires a distance, setback, or |
---|
41 | 41 | | buffer from other property or structures as a condition of the |
---|
42 | 42 | | permit, whether the required distance or setback will be met. |
---|
43 | 43 | | SECTION 2. Section 382.05198, Health and Safety Code, is |
---|
44 | 44 | | amended by amending Subsection (c) and adding Subsection (d) to |
---|
45 | 45 | | read as follows: |
---|
46 | 46 | | (c) An application for an authorization to use [the issuance |
---|
47 | 47 | | of] a standard permit issued under this section must include a plot |
---|
48 | 48 | | plan that meets the requirements of Section 382.05195(k). |
---|
49 | 49 | | (d) If the commission amends a standard permit issued under |
---|
50 | 50 | | this section, the commission may require each facility operator |
---|
51 | 51 | | authorized to begin new construction, expansion, or modification of |
---|
52 | 52 | | a facility under the former standard permit to update the |
---|
53 | 53 | | facility's plans for the new construction, expansion, or |
---|
54 | 54 | | modification in accordance with the amended standard permit if the |
---|
55 | 55 | | facility operator did not begin the construction, expansion, or |
---|
56 | 56 | | modification before the adoption of the amended permit. |
---|
57 | 57 | | SECTION 3. This Act takes effect immediately if it receives |
---|
58 | 58 | | a vote of two-thirds of all the members elected to each house, as |
---|
59 | 59 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
60 | 60 | | Act does not receive the vote necessary for immediate effect, this |
---|
61 | 61 | | Act takes effect September 1, 2025. |
