77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the construction, expansion, or modification of certain
1010 concrete plants under a standard permit.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 382.05195, Health and Safety Code, is
1313 amended by adding Subsection (f-1) and amending Subsection (k) to
1414 read as follows:
1515 (f-1) This subsection applies only to a standard permit
1616 issued under this section that authorizes the operation of a
1717 concrete plant that performs wet batching, dry batching, or central
1818 mixing, including a permanent, temporary, or specialty concrete
1919 batch plant, as defined by the commission. If the commission amends
2020 the standard permit, the commission may require each facility
2121 operator authorized to begin new construction, expansion, or
2222 modification of a facility under the former standard permit to
2323 update the facility's plans for the new construction, expansion, or
2424 modification in accordance with the amended standard permit if the
2525 facility operator did not begin the construction, expansion, or
2626 modification before the adoption of the amended permit.
2727 (k) An application for an authorization to use [the issuance
2828 of] a standard permit issued under this section for a concrete plant
2929 that performs wet batching, dry batching, or central mixing,
3030 including a permanent, temporary, or specialty concrete batch
3131 plant, as defined by the commission, must include a plot plan that
3232 clearly shows:
3333 (1) a distance scale;
3434 (2) a north arrow;
3535 (3) all property lines, emission points, buildings,
3636 tanks, and process vessels and other process equipment in the area
3737 in which the facility will be located;
3838 (4) at least two benchmark locations in the area in
3939 which the facility will be located; and
4040 (5) if the permit requires a distance, setback, or
4141 buffer from other property or structures as a condition of the
4242 permit, whether the required distance or setback will be met.
4343 SECTION 2. Section 382.05198, Health and Safety Code, is
4444 amended by amending Subsection (c) and adding Subsection (d) to
4545 read as follows:
4646 (c) An application for an authorization to use [the issuance
4747 of] a standard permit issued under this section must include a plot
4848 plan that meets the requirements of Section 382.05195(k).
4949 (d) If the commission amends a standard permit issued under
5050 this section, the commission may require each facility operator
5151 authorized to begin new construction, expansion, or modification of
5252 a facility under the former standard permit to update the
5353 facility's plans for the new construction, expansion, or
5454 modification in accordance with the amended standard permit if the
5555 facility operator did not begin the construction, expansion, or
5656 modification before the adoption of the amended permit.
5757 SECTION 3. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2025.
