57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to reporting information regarding certain evidence
810 collection kits.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 420.034, Government Code, is amended by
1113 amending Subsection (h) and adding Subsection (i) to read as
1214 follows:
1315 (h) Not later than December 1 of each year, the department
1416 shall submit a report to the governor, lieutenant governor, speaker
1517 of the house of representatives, and members of the legislature
1618 identifying the number of evidence collection kits:
1719 (1) that have not yet been submitted for laboratory
1820 analysis or for which the laboratory analysis has not yet been
1921 completed, as applicable; and
2022 (2) that a law enforcement agency did not take
2123 possession of within the period required by Section 420.035(b) or
2224 (c), as applicable.
2325 (i) The annual report required by Subsection (h) must be
2426 titled "Statewide Electronic Tracking System Report" and must be
2527 posted on the department's publicly accessible Internet website.
2628 SECTION 2. Section 351.257, Local Government Code, is
2729 amended to read as follows:
2830 Sec. 351.257. REPORT. Not later than December 1 of each
2931 odd-numbered year, a response team shall provide to the
3032 commissioners court of each county the response team serves a
3133 report that includes:
3234 (1) a list of response team members able to
3335 participate in the quarterly meetings required by Section
3436 351.254(c);
3537 (2) a copy of the written protocol developed under
3638 Section 351.256; and
3739 (3) either:
3840 (A) a biennial summary detailing:
3941 (i) the number of sexual assault reports
4042 received by local law enforcement agencies;
4143 (ii) the number of investigations conducted
4244 as a result of those reports;
4345 (iii) the number of indictments presented
4446 in connection with a report and the disposition of those cases;
4547 [and]
4648 (iv) the number of reports of sexual
4749 assault for which no indictment was presented; and
4850 (v) the number of evidence collection kits
4951 described by Section 420.031, Government Code, that a law
5052 enforcement agency did not take possession of within the period
5153 required by Section 420.035(b) or (c), Government Code, as
5254 applicable; or
5355 (B) an explanation of the reason the response
5456 team failed to provide the information described by Paragraph (A).
5557 SECTION 3. This Act takes effect September 1, 2025.
