| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Section 420.034, Government Code, is amended by |
|---|
| 11 | 13 | | amending Subsection (h) and adding Subsection (i) to read as |
|---|
| 12 | 14 | | follows: |
|---|
| 13 | 15 | | (h) Not later than December 1 of each year, the department |
|---|
| 14 | 16 | | shall submit a report to the governor, lieutenant governor, speaker |
|---|
| 15 | 17 | | of the house of representatives, and members of the legislature |
|---|
| 16 | 18 | | identifying the number of evidence collection kits: |
|---|
| 17 | 19 | | (1) that have not yet been submitted for laboratory |
|---|
| 18 | 20 | | analysis or for which the laboratory analysis has not yet been |
|---|
| 19 | 21 | | completed, as applicable; and |
|---|
| 20 | 22 | | (2) that a law enforcement agency did not take |
|---|
| 21 | 23 | | possession of within the period required by Section 420.035(b) or |
|---|
| 22 | 24 | | (c), as applicable. |
|---|
| 23 | 25 | | (i) The annual report required by Subsection (h) must be |
|---|
| 24 | 26 | | titled "Statewide Electronic Tracking System Report" and must be |
|---|
| 25 | 27 | | posted on the department's publicly accessible Internet website. |
|---|
| 26 | 28 | | SECTION 2. Section 351.257, Local Government Code, is |
|---|
| 27 | 29 | | amended to read as follows: |
|---|
| 28 | 30 | | Sec. 351.257. REPORT. Not later than December 1 of each |
|---|
| 29 | 31 | | odd-numbered year, a response team shall provide to the |
|---|
| 30 | 32 | | commissioners court of each county the response team serves a |
|---|
| 31 | 33 | | report that includes: |
|---|
| 32 | 34 | | (1) a list of response team members able to |
|---|
| 33 | 35 | | participate in the quarterly meetings required by Section |
|---|
| 34 | 36 | | 351.254(c); |
|---|
| 35 | 37 | | (2) a copy of the written protocol developed under |
|---|
| 36 | 38 | | Section 351.256; and |
|---|
| 37 | 39 | | (3) either: |
|---|
| 38 | 40 | | (A) a biennial summary detailing: |
|---|
| 39 | 41 | | (i) the number of sexual assault reports |
|---|
| 40 | 42 | | received by local law enforcement agencies; |
|---|
| 41 | 43 | | (ii) the number of investigations conducted |
|---|
| 42 | 44 | | as a result of those reports; |
|---|
| 43 | 45 | | (iii) the number of indictments presented |
|---|
| 44 | 46 | | in connection with a report and the disposition of those cases; |
|---|
| 45 | 47 | | [and] |
|---|
| 46 | 48 | | (iv) the number of reports of sexual |
|---|
| 47 | 49 | | assault for which no indictment was presented; and |
|---|
| 48 | 50 | | (v) the number of evidence collection kits |
|---|
| 49 | 51 | | described by Section 420.031, Government Code, that a law |
|---|
| 50 | 52 | | enforcement agency did not take possession of within the period |
|---|
| 51 | 53 | | required by Section 420.035(b) or (c), Government Code, as |
|---|
| 52 | 54 | | applicable; or |
|---|
| 53 | 55 | | (B) an explanation of the reason the response |
|---|
| 54 | 56 | | team failed to provide the information described by Paragraph (A). |
|---|
| 55 | 57 | | SECTION 3. This Act takes effect September 1, 2025. |
