| 9 | 9 | | relating to eligibility for Medicaid for breast and cervical |
|---|
| 10 | 10 | | cancer. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 32.024(y), Human Resources Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (y) The commission shall provide medical assistance to a |
|---|
| 15 | 15 | | person in need of treatment for breast or cervical cancer who is |
|---|
| 16 | 16 | | eligible for that assistance under the Breast and Cervical Cancer |
|---|
| 17 | 17 | | Prevention and Treatment Act of 2000 (Pub. L. No. 106-354) and who |
|---|
| 18 | 18 | | has a family income that is at or below 250 percent of the federal |
|---|
| 19 | 19 | | poverty level. The commission shall provide the assistance for a |
|---|
| 20 | 20 | | continuous period during which the person requires that |
|---|
| 21 | 21 | | treatment. The executive commissioner shall simplify the provider |
|---|
| 22 | 22 | | enrollment process for a provider of that medical assistance and |
|---|
| 23 | 23 | | shall adopt rules to provide for certification of presumptive |
|---|
| 24 | 24 | | eligibility of a person for that assistance. In determining a |
|---|
| 25 | 25 | | person's eligibility for medical assistance under this subsection, |
|---|
| 26 | 26 | | the executive commissioner, to the extent allowed by federal law, |
|---|
| 27 | 27 | | may not require a personal interview. |
|---|
| 28 | 28 | | SECTION 2. Section 32.024(y), Human Resources Code, as |
|---|
| 29 | 29 | | amended by this Act, applies only to an initial determination or |
|---|
| 30 | 30 | | recertification of eligibility of a person for medical assistance |
|---|
| 31 | 31 | | for breast or cervical cancer under Section 32.024(y), Human |
|---|
| 32 | 32 | | Resources Code, made on or after the date the section is |
|---|
| 33 | 33 | | implemented, regardless of the date the person applied for that |
|---|
| 34 | 34 | | assistance. |
|---|
| 35 | 35 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 36 | 36 | | a state agency determines that a waiver or authorization from a |
|---|
| 37 | 37 | | federal agency is necessary for implementation of that provision, |
|---|
| 38 | 38 | | the agency affected by the provision shall request the waiver or |
|---|
| 39 | 39 | | authorization and may delay implementing that provision until the |
|---|
| 40 | 40 | | waiver or authorization is granted. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2025. |
