77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to eligibility for Medicaid for breast and cervical
1010 cancer.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.024(y), Human Resources Code, is
1313 amended to read as follows:
1414 (y) The commission shall provide medical assistance to a
1515 person in need of treatment for breast or cervical cancer who is
1616 eligible for that assistance under the Breast and Cervical Cancer
1717 Prevention and Treatment Act of 2000 (Pub. L. No. 106-354) and who
1818 has a family income that is at or below 250 percent of the federal
1919 poverty level. The commission shall provide the assistance for a
2020 continuous period during which the person requires that
2121 treatment. The executive commissioner shall simplify the provider
2222 enrollment process for a provider of that medical assistance and
2323 shall adopt rules to provide for certification of presumptive
2424 eligibility of a person for that assistance. In determining a
2525 person's eligibility for medical assistance under this subsection,
2626 the executive commissioner, to the extent allowed by federal law,
2727 may not require a personal interview.
2828 SECTION 2. Section 32.024(y), Human Resources Code, as
2929 amended by this Act, applies only to an initial determination or
3030 recertification of eligibility of a person for medical assistance
3131 for breast or cervical cancer under Section 32.024(y), Human
3232 Resources Code, made on or after the date the section is
3333 implemented, regardless of the date the person applied for that
3434 assistance.
3535 SECTION 3. If before implementing any provision of this Act
3636 a state agency determines that a waiver or authorization from a
3737 federal agency is necessary for implementation of that provision,
3838 the agency affected by the provision shall request the waiver or
3939 authorization and may delay implementing that provision until the
4040 waiver or authorization is granted.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2025.
