77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to elimination of limitations periods for suits for
1010 personal injury arising from certain offenses against a child.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 16.003(a), Civil Practice and Remedies
1313 Code, is amended to read as follows:
1414 (a) Except as provided by Sections 16.010, 16.0031, [and]
1515 16.0045, and 16.0046, a person must bring suit for trespass for
1616 injury to the estate or to the property of another, conversion of
1717 personal property, taking or detaining the personal property of
1818 another, personal injury, forcible entry and detainer, and forcible
1919 detainer not later than two years after the day the cause of action
2020 accrues.
2121 SECTION 2. Section 16.0045(a), Civil Practice and Remedies
2222 Code, is amended to read as follows:
2323 (a) A person must bring suit for personal injury not later
2424 than 30 years after the day the cause of action accrues if the
2525 injury arises as a result of conduct that violates:
2626 (1) [Section 22.011(a)(2), Penal Code (sexual assault
2727 of a child);
2828 [(2) Section 22.021(a)(1)(B), Penal Code (aggravated
2929 sexual assault of a child);
3030 [(3)] Section 21.02, Penal Code (continuous sexual
3131 abuse of young child or disabled individual), unless the victim is a
3232 child younger than 14 years of age;
3333 (2) [(4)] Section 20A.02(a)(7)(A), [(B),] (C), (D),
3434 or (H) or Section 20A.02(a)(8), Penal Code, involving an activity
3535 described by Section 20A.02(a)(7)(A), [(B),] (C), (D), or (H) or
3636 sexual conduct with a [child or] disabled individual trafficked in
3737 the manner described by Section 20A.02(a)(7), Penal Code (certain
3838 sexual trafficking); or
3939 (3) [(5)] Section 43.05(a)(3) [43.05(a)(2) or (3)],
4040 Penal Code (compelling prostitution by a [child or] disabled
4141 individual)[; or
4242 [(6) Section 21.11, Penal Code (indecency with a
4343 child)].
4444 SECTION 3. Subchapter A, Chapter 16, Civil Practice and
4545 Remedies Code, is amended by adding Section 16.0046 to read as
4646 follows:
4747 Sec. 16.0046. NO LIMITATIONS PERIOD. A person may bring a
4848 suit for personal injury at any time if the injury arises as a
4949 result of conduct that violates:
5050 (1) Section 22.011(a)(2), Penal Code (sexual assault
5151 of a child);
5252 (2) Section 22.021(a)(1)(B), Penal Code (aggravated
5353 sexual assault of a child);
5454 (3) Section 21.02, Penal Code (continuous sexual abuse
5555 of young child or disabled individual), if the victim is a child
5656 younger than 14 years of age;
5757 (4) Section 20A.02(a)(7)(A), (B), (C), (D), or (H) or
5858 Section 20A.02(a)(8), Penal Code, involving an activity described
5959 by Section 20A.02(a)(7)(A), (B), (C), (D), or (H), if the victim is
6060 a child, or sexual conduct with a child trafficked in the manner
6161 described by Section 20A.02(a)(7), Penal Code (certain sexual
6262 trafficking of a child);
6363 (5) Section 43.05(a)(2), Penal Code (compelling
6464 prostitution by a child); or
6565 (6) Section 21.11, Penal Code (indecency with a
6666 child).
6767 SECTION 4. (a) Except as provided by Subsection (b) of this
6868 section, the changes in law made by this Act apply to a cause of
6969 action that accrues before, on, or after the effective date of this
7070 Act, regardless of whether:
7171 (1) the limitations period applicable to the cause of
7272 action immediately before the effective date of this Act expired
7373 before the effective date of this Act; or
7474 (2) the cause of action was the subject of a claim for
7575 which a limitations period applicable to the cause of action before
7676 the effective date of this Act was determinative.
7777 (b) The changes in law made by this Act do not affect a
7878 judgment in litigation:
7979 (1) that became final before the effective date of
8080 this Act; and
8181 (2) for which the limitations period applicable to the
8282 cause of action before the effective date of this Act was not
8383 determinative.
8484 SECTION 5. This Act takes effect September 1, 2025.
