77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to criminal penalties and defenses to prosecution for
1010 certain drug possession and drug paraphernalia offenses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 481.115(h), Health and Safety Code, is
1313 amended to read as follows:
1414 (h) The defense to prosecution provided by Subsection (g) is
1515 not available if[:
1616 [(1)] at the time the request for emergency medical
1717 assistance was made:
1818 (1) [(A)] a peace officer was in the process of
1919 arresting the actor or executing a search warrant describing the
2020 actor or the place from which the request for medical assistance was
2121 made; or
2222 (2) [(B)] the actor is committing another offense,
2323 other than an offense punishable under Section 481.1151(b)(1),
2424 481.116(b), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
2525 481.121(b)(1) or (2), or an offense under Section 481.119(b),
2626 [481.125(a),] 483.041(a), or 485.031(a)[;
2727 [(2) the actor has been previously convicted of or
2828 placed on deferred adjudication community supervision for an
2929 offense under this chapter or Chapter 483 or 485;
3030 [(3) the actor was acquitted in a previous proceeding
3131 in which the actor successfully established the defense under that
3232 subsection or Section 481.1151(c), 481.116(f), 481.1161(c),
3333 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
3434 483.041(e), or 485.031(c); or
3535 [(4) at any time during the 18-month period preceding
3636 the date of the commission of the instant offense, the actor
3737 requested emergency medical assistance in response to the possible
3838 overdose of the actor or another person].
3939 SECTION 2. Section 481.1151(d), Health and Safety Code, is
4040 amended to read as follows:
4141 (d) The defense to prosecution provided by Subsection (c) is
4242 not available if[:
4343 [(1)] at the time the request for emergency medical
4444 assistance was made:
4545 (1) [(A)] a peace officer was in the process of
4646 arresting the actor or executing a search warrant describing the
4747 actor or the place from which the request for medical assistance was
4848 made; or
4949 (2) [(B)] the actor is committing another offense,
5050 other than an offense punishable under Section 481.115(b),
5151 481.116(b), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
5252 481.121(b)(1) or (2), or an offense under Section 481.119(b),
5353 [481.125(a),] 483.041(a), or 485.031(a)[;
5454 [(2) the actor has been previously convicted of or

6666 SECTION 3. Section 481.116(g), Health and Safety Code, is
6767 amended to read as follows:
6868 (g) The defense to prosecution provided by Subsection (f) is
6969 not available if[:
7070 [(1)] at the time the request for emergency medical
7171 assistance was made:
7272 (1) [(A)] a peace officer was in the process of
7373 arresting the actor or executing a search warrant describing the
7474 actor or the place from which the request for medical assistance was
7575 made; or
7676 (2) [(B)] the actor is committing another offense,
7777 other than an offense punishable under Section 481.115(b),
7878 481.1151(b)(1), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
7979 481.121(b)(1) or (2), or an offense under Section 481.119(b),
8080 [481.125(a),] 483.041(a), or 485.031(a)[;
8181 [(2) the actor has been previously convicted of or
8282 placed on deferred adjudication community supervision for an
8383 offense under this chapter or Chapter 483 or 485;

9393 SECTION 4. Section 481.1161(d), Health and Safety Code, is
9494 amended to read as follows:
9595 (d) The defense to prosecution provided by Subsection (c) is
9696 not available if[:
9797 [(1)] at the time the request for emergency medical
9898 assistance was made:
9999 (1) [(A)] a peace officer was in the process of
100100 arresting the actor or executing a search warrant describing the
101101 actor or the place from which the request for medical assistance was

103103 (2) [(B)] the actor is committing another offense,

120120 SECTION 5. Section 481.117(g), Health and Safety Code, is
121121 amended to read as follows:
122122 (g) The defense to prosecution provided by Subsection (f) is
123123 not available if[:
124124 [(1)] at the time the request for emergency medical
125125 assistance was made:
126126 (1) [(A)] a peace officer was in the process of
127127 arresting the actor or executing a search warrant describing the

147147 SECTION 6. Section 481.118(g), Health and Safety Code, is
148148 amended to read as follows:
149149 (g) The defense to prosecution provided by Subsection (f) is
150150 not available if[:
151151 [(1)] at the time the request for emergency medical
152152 assistance was made:
153153 (1) [(A)] a peace officer was in the process of
154154 arresting the actor or executing a search warrant describing the
155155 actor or the place from which the request for medical assistance was
156156 made; or
157157 (2) [(B)] the actor is committing another offense,
158158 other than an offense punishable under Section 481.115(b),
159159 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b), or
160160 481.121(b)(1) or (2), or an offense under Section 481.119(b),

174174 SECTION 7. Section 481.119(d), Health and Safety Code, is
175175 amended to read as follows:
176176 (d) The defense to prosecution provided by Subsection (c) is
177177 not available if[:
178178 [(1)] at the time the request for emergency medical
179179 assistance was made:
180180 (1) [(A)] a peace officer was in the process of
181181 arresting the actor or executing a search warrant describing the
182182 actor or the place from which the request for medical assistance was
183183 made; or
184184 (2) [(B)] the actor is committing another offense,
185185 other than an offense punishable under Section 481.115(b),
186186 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
187187 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
188188 [481.125(a),] 483.041(a), or 485.031(a)[;
189189 [(2) the actor has been previously convicted of or
190190 placed on deferred adjudication community supervision for an
191191 offense under this chapter or Chapter 483 or 485;
192192 [(3) the actor was acquitted in a previous proceeding
193193 in which the actor successfully established the defense under that
194194 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
195195 481.1161(c), 481.117(f), 481.118(f), 481.121(c), 481.125(g),
196196 483.041(e), or 485.031(c); or
197197 [(4) at any time during the 18-month period preceding
198198 the date of the commission of the instant offense, the actor
199199 requested emergency medical assistance in response to the possible
200200 overdose of the actor or another person].
201201 SECTION 8. Sections 481.121(a), (b), and (d), Health and
202202 Safety Code, are amended to read as follows:
203203 (a) Except as authorized by this chapter, a person commits
204204 an offense if the person knowingly or intentionally possesses a
205205 usable quantity of marihuana greater than one ounce.
206206 (b) An offense under Subsection (a) is:
207207 (1) a Class B misdemeanor if the amount of marihuana
208208 possessed is two ounces or less but more than one ounce;
209209 (2) a Class A misdemeanor if the amount of marihuana
210210 possessed is four ounces or less but more than two ounces;
211211 (3) a state jail felony if the amount of marihuana
212212 possessed is five pounds or less but more than four ounces;
213213 (4) a felony of the third degree if the amount of
214214 marihuana possessed is 50 pounds or less but more than 5 pounds;
215215 (5) a felony of the second degree if the amount of
216216 marihuana possessed is 2,000 pounds or less but more than 50 pounds;
217217 and
218218 (6) a felony of the first degree punishable by
219219 imprisonment in the Texas Department of Criminal Justice for life
220220 or for a term of not more than 99 years or less than 5 years, and a
221221 fine not to exceed $50,000, if the amount of marihuana possessed is
222222 more than 2,000 pounds.
223223 (d) The defense to prosecution provided by Subsection (c) is
224224 not available if[:
225225 [(1)] at the time the request for emergency medical
226226 assistance was made:
227227 (1) [(A)] a peace officer was in the process of
228228 arresting the actor or executing a search warrant describing the
229229 actor or the place from which the request for medical assistance was
230230 made; or
231231 (2) [(B)] the actor is committing another offense,
232232 other than an offense punishable under Section 481.115(b),
233233 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b), or
234234 481.118(b), or an offense under Section 481.119(b), [481.125(a),]
235235 483.041(a), or 485.031(a)[;
236236 [(2) the actor has been previously convicted of or
237237 placed on deferred adjudication community supervision for an
238238 offense under this chapter or Chapter 483 or 485;
239239 [(3) the actor was acquitted in a previous proceeding
240240 in which the actor successfully established the defense under that
241241 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
242242 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.125(g),
243243 483.041(e), or 485.031(c); or
244244 [(4) at any time during the 18-month period preceding
245245 the date of the commission of the instant offense, the actor
246246 requested emergency medical assistance in response to the possible
247247 overdose of the actor or another person].
248248 SECTION 9. The heading to Section 481.125, Health and
249249 Safety Code, is amended to read as follows:
250250 Sec. 481.125. OFFENSE: [POSSESSION OR] DELIVERY OF DRUG
251251 PARAPHERNALIA.
252252 SECTION 10. Section 483.041(f), Health and Safety Code, is
253253 amended to read as follows:
254254 (f) The defense to prosecution provided by Subsection (e) is
255255 not available if[:
256256 [(1)] at the time the request for emergency medical
257257 assistance was made:
258258 (1) [(A)] a peace officer was in the process of
259259 arresting the actor or executing a search warrant describing the
260260 actor or the place from which the request for medical assistance was
261261 made; or
262262 (2) [(B)] the actor is committing another offense,
263263 other than an offense punishable under Section 481.115(b),
264264 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
265265 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
266266 481.119(b), [481.125(a),] or 485.031(a)[;
267267 [(2) the actor has been previously convicted of or
268268 placed on deferred adjudication community supervision for an
269269 offense under this chapter or Chapter 481 or 485;
270270 [(3) the actor was acquitted in a previous proceeding
271271 in which the actor successfully established the defense under that
272272 subsection or Section 481.115(g), 481.1151(c), 481.116(f),

279279 SECTION 11. Section 485.031(d), Health and Safety Code, is
280280 amended to read as follows:
281281 (d) The defense to prosecution provided by Subsection (c) is
282282 not available if[:
283283 [(1)] at the time the request for emergency medical
284284 assistance was made:
285285 (1) [(A)] a peace officer was in the process of
286286 arresting the actor or executing a search warrant describing the
287287 actor or the place from which the request for medical assistance was
288288 made; or
289289 (2) [(B)] the actor is committing another offense,
290290 other than an offense punishable under Section 481.115(b),
291291 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
292292 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
293293 481.119(b), [481.125(a),] or 483.041(a)[;
294294 [(2) the actor has been previously convicted of or
295295 placed on deferred adjudication community supervision for an
296296 offense under this chapter or Chapter 481 or 483;
297297 [(3) the actor was acquitted in a previous proceeding
298298 in which the actor successfully established the defense under that
299299 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
300300 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.121(c),

302302 [(4) at any time during the 18-month period preceding
303303 the date of the commission of the instant offense, the actor
304304 requested emergency medical assistance in response to the possible
305305 overdose of the actor or another person].
306306 SECTION 12. Sections 481.125(a), (d), (g), (h), and (i),
307307 Health and Safety Code, are repealed.
308308 SECTION 13. (a) Except as provided by Subsection (b), the
309309 changes in law made by this Act apply only to an offense committed
310310 on or after the effective date of this Act. An offense committed
311311 before the effective date of this Act is governed by the law in
312312 effect on the date the offense was committed, and the former law is
313313 continued in effect for that purpose. For purposes of this section,
314314 an offense was committed before the effective date of this Act if
315315 any element of the offense occurred before that date.
316316 (b) The change in law made by this Act to Section 481.125,
317317 Health and Safety Code, applies to conduct that occurs before, on,
318318 or after the effective date of this Act, except that a final
319319 conviction for an offense that exists on the effective date of this
320320 Act is unaffected by this Act.
321321 SECTION 14. This Act takes effect September 1, 2025.
