11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. The heading to Section 481.07636, Health and |
---|
13 | 13 | | Safety Code, is amended to read as follows: |
---|
14 | 14 | | Sec. 481.07636. PRESCRIBING OPIOID FOR ACUTE PAIN; |
---|
15 | 15 | | PRESCRIPTION LIMITS. |
---|
16 | 16 | | SECTION 2. Section 481.07636, Health and Safety Code, is |
---|
17 | 17 | | amended by adding Subsection (b-1) and amending Subsection (c) to |
---|
18 | 18 | | read as follows: |
---|
19 | 19 | | (b-1) A prescriber who prescribes an opioid to a person for |
---|
20 | 20 | | the treatment of acute pain shall also prescribe to the person an |
---|
21 | 21 | | opioid antagonist. |
---|
22 | 22 | | (c) Subsections [Subsection] (b) and (b-1) do [does] not |
---|
23 | 23 | | apply to a prescription for an opioid approved by the United States |
---|
24 | 24 | | Food and Drug Administration for the treatment of substance |
---|
25 | 25 | | addiction that is issued by a practitioner for the treatment of |
---|
26 | 26 | | substance addiction. |
---|
27 | 27 | | SECTION 3. Subchapter C, Chapter 481, Health and Safety |
---|
28 | 28 | | Code, is amended by adding Section 481.07637 to read as follows: |
---|
29 | 29 | | Sec. 481.07637. ALTERNATIVE TREATMENTS FOR ACUTE PAIN. (a) |
---|
30 | 30 | | In this section, "acute pain" has the meaning assigned by Section |
---|
31 | 31 | | 481.07636. |
---|
32 | 32 | | (b) When issuing an opioid prescription for acute pain, a |
---|
33 | 33 | | prescriber shall also consider referring or prescribing any of the |
---|
34 | 34 | | following pain management services to a patient, based on the |
---|
35 | 35 | | prescriber's clinical judgment and the availability of the |
---|
36 | 36 | | treatment: |
---|
37 | 37 | | (1) chiropractic treatment; |
---|
38 | 38 | | (2) physical therapies; |
---|
39 | 39 | | (3) occupational therapies; |
---|
40 | 40 | | (4) physical medicine and rehabilitation; or |
---|
41 | 41 | | (5) osteopathic manipulation. |
---|
42 | 42 | | (c) This section does not require that all of the treatments |
---|
43 | 43 | | under Subsection (b) be exhausted before the patient may receive a |
---|
44 | 44 | | prescription for an opioid. |
---|
45 | 45 | | SECTION 4. Section 481.003(a), Health and Safety Code, is |
---|
46 | 46 | | amended to read as follows: |
---|
47 | 47 | | (a) The director may adopt rules to administer and enforce |
---|
48 | 48 | | this chapter, other than Sections 481.074, 481.075, 481.0755, |
---|
49 | 49 | | 481.0756, 481.076, 481.0761, 481.0762, 481.0763, 481.07635, |
---|
50 | 50 | | 481.07636, 481.07637, 481.0764, 481.0765, 481.0766, 481.0767, |
---|
51 | 51 | | 481.0768, and 481.0769. The board may adopt rules to administer |
---|
52 | 52 | | Sections 481.074, 481.075, 481.0755, 481.0756, 481.076, 481.0761, |
---|
53 | 53 | | 481.0762, 481.0763, 481.07635, 481.07636, 481.07637, 481.0764, |
---|
54 | 54 | | 481.0765, 481.0766, 481.0767, 481.0768, and 481.0769. |

55 | 55 | | SECTION 5. Section 554.051(a-1), Occupations Code, is |

56 | 56 | | amended to read as follows: |

61 | 61 | | SECTION 6. Section 565.003, Occupations Code, as amended by |

62 | 62 | | Chapters 1105 (H.B. 2174) and 1166 (H.B. 3284), Acts of the 86th |

63 | 63 | | Legislature, Regular Session, 2019, is reenacted to read as |
---|
64 | 64 | | follows: |
---|
65 | 65 | | Sec. 565.003. ADDITIONAL GROUNDS FOR DISCIPLINE REGARDING |
---|
66 | 66 | | APPLICANT FOR OR HOLDER OF NONRESIDENT PHARMACY LICENSE. Unless |
---|
67 | 67 | | compliance would violate the pharmacy or drug statutes or rules in |
---|
68 | 68 | | the state in which the pharmacy is located, the board may discipline |
---|
69 | 69 | | an applicant for or the holder of a nonresident pharmacy license if |
---|
70 | 70 | | the board finds that the applicant or license holder has failed to |
---|
71 | 71 | | comply with: |
---|
72 | 72 | | (1) Subchapter C, Chapter 481, Health and Safety Code; |
---|
73 | 73 | | (2) Texas substitution requirements regarding: |
---|
74 | 74 | | (A) the practitioner's directions concerning |
---|
75 | 75 | | generic substitution; |
---|
76 | 76 | | (B) the patient's right to refuse generic |
---|
77 | 77 | | substitution; or |
---|
78 | 78 | | (C) notification to the patient of the patient's |
---|
79 | 79 | | right to refuse substitution; |
---|
80 | 80 | | (3) any board rule relating to providing drug |
---|
81 | 81 | | information to the patient or the patient's agent in written form or |
---|
82 | 82 | | by telephone; or |
---|
83 | 83 | | (4) any board rule adopted under Section 554.051(a) |
---|
84 | 84 | | and determined by the board to be applicable under Section |
---|
85 | 85 | | 554.051(b). |
---|
86 | 86 | | SECTION 7. This Act takes effect September 1, 2025. |
