77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the duties of a prescriber issuing an opioid
1010 prescription to treat acute pain.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 481.07636, Health and
1313 Safety Code, is amended to read as follows:
1414 Sec. 481.07636. PRESCRIBING OPIOID FOR ACUTE PAIN;
1515 PRESCRIPTION LIMITS.
1616 SECTION 2. Section 481.07636, Health and Safety Code, is
1717 amended by adding Subsection (b-1) and amending Subsection (c) to
1818 read as follows:
1919 (b-1) A prescriber who prescribes an opioid to a person for
2020 the treatment of acute pain shall also prescribe to the person an
2121 opioid antagonist.
2222 (c) Subsections [Subsection] (b) and (b-1) do [does] not
2323 apply to a prescription for an opioid approved by the United States
2424 Food and Drug Administration for the treatment of substance
2525 addiction that is issued by a practitioner for the treatment of
2626 substance addiction.
2727 SECTION 3. Subchapter C, Chapter 481, Health and Safety
2828 Code, is amended by adding Section 481.07637 to read as follows:
2929 Sec. 481.07637. ALTERNATIVE TREATMENTS FOR ACUTE PAIN. (a)
3030 In this section, "acute pain" has the meaning assigned by Section
3131 481.07636.
3232 (b) When issuing an opioid prescription for acute pain, a
3333 prescriber shall also consider referring or prescribing any of the
3434 following pain management services to a patient, based on the
3535 prescriber's clinical judgment and the availability of the
3636 treatment:
3737 (1) chiropractic treatment;
3838 (2) physical therapies;
3939 (3) occupational therapies;
4040 (4) physical medicine and rehabilitation; or
4141 (5) osteopathic manipulation.
4242 (c) This section does not require that all of the treatments
4343 under Subsection (b) be exhausted before the patient may receive a
4444 prescription for an opioid.
4545 SECTION 4. Section 481.003(a), Health and Safety Code, is
4646 amended to read as follows:
4747 (a) The director may adopt rules to administer and enforce
4848 this chapter, other than Sections 481.074, 481.075, 481.0755,
4949 481.0756, 481.076, 481.0761, 481.0762, 481.0763, 481.07635,
5050 481.07636, 481.07637, 481.0764, 481.0765, 481.0766, 481.0767,
5151 481.0768, and 481.0769. The board may adopt rules to administer
5252 Sections 481.074, 481.075, 481.0755, 481.0756, 481.076, 481.0761,
5353 481.0762, 481.0763, 481.07635, 481.07636, 481.07637, 481.0764,
5454 481.0765, 481.0766, 481.0767, 481.0768, and 481.0769.
5555 SECTION 5. Section 554.051(a-1), Occupations Code, is
5656 amended to read as follows:
5757 (a-1) The board may adopt rules to administer Sections
5858 481.074, 481.075, 481.0755, 481.0756, 481.076, 481.0761, 481.0762,
5959 481.0763, 481.07635, 481.07636, 481.07637, 481.0764, 481.0765,
6060 481.0766, 481.0767, 481.0768, and 481.0769, Health and Safety Code.
6161 SECTION 6. Section 565.003, Occupations Code, as amended by
6262 Chapters 1105 (H.B. 2174) and 1166 (H.B. 3284), Acts of the 86th
6363 Legislature, Regular Session, 2019, is reenacted to read as
6464 follows:
6565 Sec. 565.003. ADDITIONAL GROUNDS FOR DISCIPLINE REGARDING
6666 APPLICANT FOR OR HOLDER OF NONRESIDENT PHARMACY LICENSE. Unless
6767 compliance would violate the pharmacy or drug statutes or rules in
6868 the state in which the pharmacy is located, the board may discipline
6969 an applicant for or the holder of a nonresident pharmacy license if
7070 the board finds that the applicant or license holder has failed to
7171 comply with:
7272 (1) Subchapter C, Chapter 481, Health and Safety Code;
7373 (2) Texas substitution requirements regarding:
7474 (A) the practitioner's directions concerning
7575 generic substitution;
7676 (B) the patient's right to refuse generic
7777 substitution; or
7878 (C) notification to the patient of the patient's
7979 right to refuse substitution;
8080 (3) any board rule relating to providing drug
8181 information to the patient or the patient's agent in written form or
8282 by telephone; or
8383 (4) any board rule adopted under Section 554.051(a)
8484 and determined by the board to be applicable under Section
8585 554.051(b).
8686 SECTION 7. This Act takes effect September 1, 2025.
