108 AN ACT
119 relating to increasing the criminal penalty for certain conduct
1210 constituting the offense of dog fighting or the offense of
1311 cockfighting.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1513 SECTION 1. Section 42.10(e), Penal Code, is amended to read
1614 as follows:
1715 (e) Except as otherwise provided by this subsection, an
1816 offense under this section is a state jail felony. An offense under
1917 Subsection (a)(6) [(a)(4), (5), or (6)] is a Class A misdemeanor.
2018 [An offense under Subsection (a)(1), (2), or (3) is a state jail
2119 felony.]
2220 SECTION 2. Section 42.105(g), Penal Code, is amended to
2321 read as follows:
2422 (g) Except as otherwise provided by this subsection, an [An]
2523 offense under this section [Subsection (b)(1) or (2)] is a state
26- jail felony. [An offense under Subsection (b)(3), (4), or (5) is a
27- Class A misdemeanor.] An offense under Subsection (b)(6) is a Class
28- C misdemeanor, except that the offense is a Class A misdemeanor if
29- it is shown on the trial of the offense that the person has been
30- previously convicted of an offense under that subdivision.
24+ jail felony. An offense under Subsection (b)(5) [(b)(3), (4), or
25+ (5)] is a Class A misdemeanor. An offense under Subsection (b)(6)
26+ is a Class C misdemeanor, except that the offense is a Class A
27+ misdemeanor if it is shown on the trial of the offense that the
28+ person has been previously convicted of an offense under that
29+ subdivision.
3130 SECTION 3. The change in law made by this Act applies only
3231 to an offense committed on or after the effective date of this Act.
3332 An offense committed before the effective date of this Act is
3433 governed by the law in effect on the date the offense was committed,
3534 and the former law is continued in effect for that purpose. For
3635 purposes of this section, an offense was committed before the
3736 effective date of this Act if any element of the offense occurred
3837 before that date.
3938 SECTION 4. This Act takes effect September 1, 2025.
