88 AN ACT
99 relating to the self-administration of prescription anti-seizure
1010 medicine by a student at a public school.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 38.015, Education Code,
1313 is amended to read as follows:
1414 Sec. 38.015. SELF-ADMINISTRATION OF PRESCRIPTION ASTHMA,
1515 [OR] ANAPHYLAXIS, OR ANTI-SEIZURE MEDICINE BY STUDENTS.
1616 SECTION 2. Sections 38.015(a) and (b), Education Code, are
1717 amended to read as follows:
1818 (a) In this section:
1919 (1) "Parent" includes a person standing in parental
2020 relation.
2121 (2) "Self-administration of prescription asthma, [or]
2222 anaphylaxis, or anti-seizure medicine" means a student's
2323 discretionary use of prescription asthma, [or] anaphylaxis, or
2424 anti-seizure medicine.
2525 (b) A student with asthma, [or] anaphylaxis, or a seizure
2626 disorder is entitled to possess and self-administer prescription
2727 asthma, [or] anaphylaxis, or anti-seizure medicine, as applicable,
2828 while on school property or at a school-related event or activity
2929 if:
3030 (1) the prescription medicine has been prescribed for
3131 that student as indicated by the prescription label on the
3232 medicine;
3333 (2) the student has demonstrated to the student's
3434 physician or other licensed health care provider and the school
3535 nurse, if available, the skill level necessary to self-administer
3636 the prescription medication, including the use of any device
3737 required to administer the medication;
3838 (3) the self-administration is done in compliance
3939 with:
4040 (A) the prescription or written instructions
4141 from the student's physician or other licensed health care
4242 provider; or
4343 (B) for a student with a seizure disorder, the
4444 student's seizure management and treatment plan under Section
4545 38.032; and
4646 (4) a parent of the student provides to the school:
4747 (A) a written authorization, signed by the
4848 parent, for the student to self-administer the prescription
4949 medicine while on school property or at a school-related event or
5050 activity; and
5151 (B) a written statement from the student's
5252 physician or other licensed health care provider, signed by the
5353 physician or provider, that states:
5454 (i) that the student has asthma, [or]
5555 anaphylaxis, or a seizure disorder and is capable of
5656 self-administering the prescription medicine;
5757 (ii) the name and purpose of the medicine;
5858 (iii) the prescribed dosage for the
5959 medicine;
6060 (iv) the times at which or circumstances
6161 under which the medicine may be administered; and
6262 (v) the period for which the medicine is
6363 prescribed.
6464 SECTION 3. Section 38.032(b), Education Code, is amended to
6565 read as follows:
6666 (b) The agency shall adopt and post on the agency's Internet
6767 website a form to be used in submitting a seizure management and
6868 treatment plan under this section. The form must request the
6969 following information:
7070 (1) the student's name and date of birth;
7171 (2) the names and contact information of the student's
7272 parent or guardian, the physician responsible for the student's
7373 seizure treatment, and at least one other emergency contact;
7474 (3) any medical history significant to the student's
7575 seizure disorder;
7676 (4) the type, length, and frequency of the student's
7777 seizures;
7878 (5) a description of each type of seizure the student
7979 has experienced;
8080 (6) the student's seizure triggers or warning signs;
8181 (7) the student's ability to manage seizures and the
8282 student's level of understanding of the seizures;
8383 (8) instructions for the student's
8484 self-administration of prescription anti-seizure medication, if
8585 applicable;
8686 (9) the student's response after a seizure;
8787 (10) [(9)] the basic first aid to be provided to the
8888 student during a seizure, including whether the student needs to
8989 leave the classroom after a seizure and the process for the
9090 student's return to the classroom, if applicable;
9191 (11) [(10)] a description of what constitutes a
9292 seizure emergency for the student;
9393 (12) [(11)] a description of seizure emergency
9494 protocol for district personnel to follow in the event of a seizure
9595 emergency for the student;
9696 (13) [(12)] a treatment protocol for any medications
9797 or other procedures to be administered by district personnel to the
9898 student during school hours, including:
9999 (A) each daily or emergency medication,
100100 including:
101101 (i) the name and dosage of the medication
102102 and the time at which the medication is to be given;
103103 (ii) common side effects for the
104104 medication; and
105105 (iii) any special instructions regarding
106106 the medication; and
107107 (B) whether the student has a vagus nerve
108108 stimulator and, if so, appropriate magnet use for the stimulator;
109109 (14) [(13)] any special considerations or precautions
110110 applicable to the student; and
111111 (15) [(14)] the signatures of the student's parent or
112112 guardian and the physician responsible for the student's seizure
113113 treatment.
114114 SECTION 4. As soon as practicable after the effective date
115115 of this Act but not later than December 1, 2025, the Texas Education
116116 Agency shall update the form for submitting a seizure management
117117 and treatment plan as necessary to conform to Section 38.032(b),
118118 Education Code, as amended by this Act, and post the form on the
119119 agency's Internet website.
120120 SECTION 5. This Act applies beginning with the 2025-2026
121121 school year.
122122 SECTION 6. This Act takes effect immediately if it receives
123123 a vote of two-thirds of all the members elected to each house, as
124124 provided by Section 39, Article III, Texas Constitution. If this
125125 Act does not receive the vote necessary for immediate effect, this
126126 Act takes effect September 1, 2025.
