108 AN ACT
11- relating to prohibited insurance discrimination on the basis of an
12- insured's marital status following the death of the insured's
13- spouse.
9+ relating to prohibited insurance discrimination against insureds
10+ who are widowed.
1411 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1512 SECTION 1. Section 544.002, Insurance Code, is amended by
1613 adding Subsection (d) to read as follows:
17- (d) Notwithstanding Section 544.003, an insurer may not:
18- (1) refuse to continue to insure or provide coverage
19- to an individual or limit the amount, extent, or kind of coverage
20- available to an individual because the individual is widowed or the
21- individual's marital status otherwise reflects the death of a
22- spouse; or
23- (2) charge an individual who is widowed or whose
24- marital status otherwise reflects the death of a spouse a rate that
25- is different from the rate that would be charged if the individual's
26- marital status was married.
14+ (d) Notwithstanding Section 544.003, an insurer may not
15+ refuse to continue to insure or provide coverage to an individual,
16+ limit the amount, extent, or kind of coverage available to an
17+ individual, or charge an individual a rate that is different from
18+ the rate charged to other individuals for the same coverage on the
19+ basis that the individual is widowed.
2720 SECTION 2. The change in law made by this Act does not apply
2821 to an insurance policy that is delivered, issued for delivery, or
29- renewed before the effective date of this Act. An insurance policy
30- that is delivered, issued for delivery, or renewed before the
31- effective date of this Act is governed by the law as it existed
32- immediately before the effective date of this Act, and that law is
33- continued in effect for that purpose.

3423 SECTION 3. This Act takes effect September 1, 2025.
