77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the duration of services provided under Medicaid to
1010 women following a pregnancy.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.024(l-1), Human Resources Code, is
1313 amended to read as follows:
1414 (l-1) The commission shall continue to provide medical
1515 assistance to a woman who is eligible for medical assistance for
1616 pregnant women for a period of not less than 24[:
1717 [(1) six months following the date the woman delivers
1818 or experiences an involuntary miscarriage; and
1919 [(2) 12] months that begins on the last day of the
2020 woman's pregnancy and ends on the last day of the month in which the
2121 24-month [12-month] period ends [in accordance with Section
2222 1902(e)(16), Social Security Act (42 U.S.C. Section
2323 1396a(e)(16))].
2424 SECTION 2. If before implementing any provision of this Act
2525 a state agency determines that a waiver or authorization from a
2626 federal agency is necessary for implementation of that provision,
2727 the agency affected by the provision shall request the waiver or
2828 authorization and may delay implementing that provision until the
2929 waiver or authorization is granted.
3030 SECTION 3. This Act takes effect September 1, 2025.
