9 | 9 | relating to the duration of services provided under Medicaid to | |
10 | 10 | women following a pregnancy. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 32.024(l-1), Human Resources Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | (l-1) The commission shall continue to provide medical | |
15 | 15 | assistance to a woman who is eligible for medical assistance for | |
16 | 16 | pregnant women for a period of not less than 24[: | |
17 | 17 | [(1) six months following the date the woman delivers | |
18 | 18 | or experiences an involuntary miscarriage; and | |
19 | 19 | [(2) 12] months that begins on the last day of the | |
20 | 20 | woman's pregnancy and ends on the last day of the month in which the | |
21 | 21 | 24-month [12-month] period ends [in accordance with Section | |
22 | 22 | 1902(e)(16), Social Security Act (42 U.S.C. Section | |
23 | 23 | 1396a(e)(16))]. | |
24 | 24 | SECTION 2. If before implementing any provision of this Act | |
25 | 25 | a state agency determines that a waiver or authorization from a | |
26 | 26 | federal agency is necessary for implementation of that provision, | |
27 | 27 | the agency affected by the provision shall request the waiver or | |
28 | 28 | authorization and may delay implementing that provision until the | |
29 | 29 | waiver or authorization is granted. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2025. |
