88 AN ACT
99 relating to rest breaks for employees of certain governmental
1010 entity contractors; providing an administrative penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 2252, Government Code, is
1313 amended by adding Section 2252.911 to read as follows:
1414 Sec. 2252.911. REST BREAKS REQUIRED FOR EMPLOYEES
1515 PERFORMING CONSTRUCTION WORK UNDER CONTRACTS WITH GOVERNMENTAL
1616 ENTITIES. (a) In this section:
1717 (1) "Construction contract" means a contract or
1818 agreement for the performance of general construction.
1919 (2) "Contractor" means a person, firm, or corporation
2020 contracting with a governmental entity for general construction.
2121 (3) "Employee" means an individual paid by a
2222 contractor or subcontractor to perform general construction work or
2323 services.
2424 (4) "General construction" means:
2525 (A) erecting or preparing to erect a structure,
2626 including a building, bridge, roadway, public utility facility, or
2727 related structure;
2828 (B) remodeling, extending, repairing, or
2929 demolishing a structure; or
3030 (C) otherwise improving real property or a
3131 structure related to real property.
3232 (5) "Governmental entity" means:
3333 (A) a board, commission, department, office, or
3434 other agency in the executive branch of state government; or
3535 (B) a political subdivision of this state,
3636 including a municipality, county, public school district, or
3737 special-purpose district or authority.
3838 (6) "Rest break" means a break from work during work
3939 hours. The term does not include a regular meal period a contractor
4040 or subcontractor provides to an employee.
4141 (b) A governmental entity contracting with a contractor
4242 shall require the contractor and any subcontractor to provide to
4343 each employee performing work under the contract at least a
4444 10-minute paid rest break during every four-hour work period.
4545 (c) Each construction contract with a governmental entity
4646 must include terms that:
4747 (1) authorize an employee of a contractor or
4848 subcontractor required to work without a rest break in violation of
4949 Subsection (b) to make a verbal or written complaint to the
5050 governmental entity contracting with the contractor;
5151 (2) require, on confirmation of a violation of
5252 Subsection (b) that is the subject of a complaint, the governmental
5353 entity to provide to the contractor written notice of the violation
5454 by hand delivery or certified mail;
5555 (3) inform a contractor the governmental entity is
5656 authorized to impose an administrative penalty if the contractor
5757 fails to comply with Subsection (b) after the date on which the
5858 contractor receives notice under Subdivision (2); and
5959 (4) state that an imposed penalty amount may be
6060 withheld from a payment otherwise owed to a contractor under the
6161 contract.
6262 (d) In accordance with a construction contract governed by
6363 this section, the governmental entity may impose an administrative
6464 penalty against a contractor in an amount of not less than $100 and
6565 not more than $500 per day if a contractor or subcontractor requires
6666 any employee to work without a rest break in violation of Subsection
6767 (b). A proceeding under this section to impose an administrative
6868 penalty is a contested case under Chapter 2001.
6969 (e) Each governmental entity shall develop procedures for
7070 the administration of this section.
7171 (f) This section does not preempt a local ordinance, rule,
7272 or other measure a political subdivision of this state adopts
7373 requiring rest breaks in accordance with a construction contract
7474 that is compatible with and equal to or more stringent than the
7575 provisions of this section.
7676 SECTION 2. Section 2252.911, Government Code, as added by
7777 this Act, applies only to a contract for which the solicitation of
7878 qualifications, proposals, or other similar expressions of
7979 interest is published on or after September 1, 2025.
8080 SECTION 3. This Act takes effect September 1, 2025.
