77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the expunction of arrest records and files when a grand
1010 jury fails to find that probable cause exists to believe the alleged
1111 offense was committed.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Article 55A.052(a), Code of Criminal Procedure,
1414 is amended to read as follows:
1515 (a) A person to whom this subchapter applies is entitled to
1616 have all records and files relating to the arrest expunged if an
1717 indictment or information charging the person with the commission
1818 of a misdemeanor offense based on the person's arrest or charging
1919 the person with the commission of any felony offense arising out of
2020 the same transaction for which the person was arrested has not been
2121 presented against the person at any time following the arrest and
2222 if:
2323 (1) at least 180 days have elapsed from the date of
2424 arrest if the arrest for which the expunction was sought was for an
2525 offense punishable as a Class C misdemeanor and there was no felony
2626 charge arising out of the same transaction for which the person was
2727 arrested;
2828 (2) at least one year has elapsed from the date of
2929 arrest if the arrest for which the expunction was sought was for an
3030 offense punishable as a Class B or A misdemeanor and there was no
3131 felony charge arising out of the same transaction for which the
3232 person was arrested;
3333 (3) at least three years have elapsed from the date of
3434 arrest if the arrest for which the expunction was sought was for an
3535 offense punishable as a felony or there was a felony charge arising
3636 out of the same transaction for which the person was arrested; [or]
3737 (4) the attorney representing the state certifies that
3838 the applicable arrest records and files are not needed for use in
3939 any criminal investigation or prosecution, including an
4040 investigation or prosecution of another person; or
4141 (5) the presentment did not occur solely because the
4242 grand jury failed to find that probable cause exists to believe the
4343 person committed the offense.
4444 SECTION 2. The change in law made by this Act applies to the
4545 expunction of arrest records and files for any criminal offense
4646 that occurred before, on, or after the effective date of this Act.
4747 SECTION 3. This Act takes effect September 1, 2025.
