11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 493, Government Code, is amended by |
---|
13 | 13 | | adding Section 493.0075 to read as follows: |
---|
14 | 14 | | Sec. 493.0075. DONATION OF ACCRUED COMPENSATORY TIME OR |
---|
15 | 15 | | ACCRUED ANNUAL LEAVE FOR LEGISLATIVE PURPOSES. (a) The executive |
---|
16 | 16 | | director shall allow a correctional officer employed by the |
---|
17 | 17 | | department to voluntarily transfer to a legislative leave pool up |
---|
18 | 18 | | to eight hours of compensatory time or annual leave per year earned |
---|
19 | 19 | | by the correctional officer. |
---|
20 | 20 | | (b) The executive director or the executive director's |
---|
21 | 21 | | designee shall administer the legislative leave pool. |
---|
22 | 22 | | (c) The board shall adopt rules and prescribe procedures |
---|
23 | 23 | | relating to the operation of the legislative leave pool. |
---|
24 | 24 | | (d) The executive director or the executive director's |
---|
25 | 25 | | designee shall credit the legislative leave pool with the amount of |
---|
26 | 26 | | time contributed by a correctional officer employed by the |
---|
27 | 27 | | department and deduct a corresponding amount of time from the |
---|
28 | 28 | | correctional officer's earned compensatory time or annual leave as |
---|
29 | 29 | | if the correctional officer had used the time for personal |
---|
30 | 30 | | purposes. |
---|
31 | 31 | | (e) A correctional officer employed by the department is |
---|
32 | 32 | | entitled to use time contributed to the legislative leave pool if |
---|
33 | 33 | | the correctional officer uses the time for legislative leave on |
---|
34 | 34 | | behalf of an association: |
---|
35 | 35 | | (1) related to the correctional officer's employment |
---|
36 | 36 | | with the department; |
---|
37 | 37 | | (2) that has at least 5,000 active or retired members; |
---|
38 | 38 | | and |
---|
39 | 39 | | (3) that is governed by a board of directors. |
---|
40 | 40 | | (f) The executive director or the executive director's |
---|
41 | 41 | | designee shall transfer time from the pool to the correctional |
---|
42 | 42 | | officer and credit the time to the correctional officer. |
---|
43 | 43 | | (g) A correctional officer employed by the department may |
---|
44 | 44 | | only withdraw time from the legislative leave pool in coordination |
---|
45 | 45 | | with and with the consent of the president or designee of the |
---|
46 | 46 | | association described in Subsection (e). A correctional officer |
---|
47 | 47 | | may not draw more than 80 hours from the pool in a 160-hour work |
---|
48 | 48 | | cycle and may not draw more than 480 hours from the pool in a fiscal |
---|
49 | 49 | | year. |
---|
50 | 50 | | (h) A correctional officer employed by the department shall |
---|
51 | 51 | | use time from the legislative leave pool in accordance with rules |
---|
52 | 52 | | adopted by the board. |
---|
53 | 53 | | SECTION 2. This Act takes effect September 1, 2025. |
