77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study and report by the General Land Office on private
1010 landowner participation in border security.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. STUDY. (a) The General Land Office shall
1313 conduct a study to identify methods to increase private landowner
1414 cooperation with state border security activities, including:
1515 (1) cooperation with law enforcement relating to the
1616 offense of criminal trespass, as described by Section 30.05, Penal
1717 Code; and
1818 (2) permission granted to a state entity for:
1919 (A) the temporary placement on a landowner's
2020 property of personnel, equipment, and infrastructure relating to
2121 border security; or
2222 (B) property modification for the purpose of
2323 supporting border security.
2424 (b) The study must consider:
2525 (1) methods of incentivizing private landowner
2626 participation, including:
2727 (A) financial incentives;
2828 (B) tax abatements;
2929 (C) infrastructure improvements; and
3030 (D) installation of utilities; and
3131 (2) the amount of money required to provide the
3232 incentives described by Subdivision (1).
3333 (c) To collect data for the study, the General Land Office
3434 shall conduct in-person surveys and focus groups among private
3535 landowners, including at least 10 landowners from each county
3636 adjacent to the Texas-Mexico border, excluding Jeff Davis County,
3737 whose parcel of real property is:
3838 (1) adjacent to the Texas-Mexico border; or
3939 (2) privately held and closest in proximity to the
4040 Texas-Mexico border.
4141 (d) In conducting the study, the General Land Office shall
4242 collaborate with:
4343 (1) the comptroller of public accounts;
4444 (2) the Department of Public Safety of the State of
4545 Texas;
4646 (3) the office of the attorney general;
4747 (4) the office of the governor;
4848 (5) the Texas Department of Transportation;
4949 (6) the Texas Facilities Commission; and
5050 (7) the Texas Military Department.
5151 SECTION 2. REPORT. Not later than December 1, 2026, the
5252 General Land Office shall submit a report on the results of the
5353 study conducted under Section 1 of this Act to the legislature and
5454 each entity with which the General Land Office collaborates to
5555 conduct the study under Section 1.
5656 SECTION 3. EXPIRATION. This Act expires August 31, 2027.
5757 SECTION 4. EFFECTIVE DATE. This Act takes effect
5858 immediately if it receives a vote of two-thirds of all the members
5959 elected to each house, as provided by Section 39, Article III, Texas
6060 Constitution. If this Act does not receive the vote necessary for
6161 immediate effect, this Act takes effect September 1, 2025.
