88 AN ACT
99 relating to the verification of health care practitioner continuing
1010 education compliance through the establishment of continuing
1111 education tracking systems.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 112.002, Occupations Code, is
1414 transferred to Subchapter B, Chapter 112, Occupations Code,
1515 redesignated as Section 112.0501, Occupations Code, and amended to
1616 read as follows:
1717 Sec. 112.0501 [112.002]. APPLICABILITY. This subchapter
1818 [chapter] applies only to licensing entities and health care
1919 practitioners under Chapters 401, 453, and 454 and Subtitles B, C,
2020 D, E, F, and K.
2121 SECTION 2. Chapter 112, Occupations Code, is amended by
2222 adding Subchapter C to read as follows:
2323 SUBCHAPTER C. CONTINUING EDUCATION REQUIREMENTS
2424 Sec. 112.101. DEFINITIONS. In this subchapter:
2525 (1) "Continuing education course" means a course,
2626 clinic, forum, lecture, program, or seminar that an individual must
2727 complete in order to maintain or renew a license.
2828 (2) "Continuing education provider" means a person
2929 that a licensing entity authorizes or approves to offer continuing
3030 education courses.
3131 (3) "Continuing education tracking system" means an
3232 electronic system a licensing entity establishes as required by
3333 Section 112.104.
3434 (4) "License" means a form of authorization a
3535 licensing entity issues, including a license, certificate,
3636 registration, or permit, that an individual must obtain to engage
3737 in a particular business, occupation, or profession.
3838 Sec. 112.102. APPLICABILITY. (a) Except as provided by
3939 Subsection (b), this subchapter applies only to a licensing entity
4040 that issues a license to a health care practitioner under this
4141 title.
4242 (b) This subchapter does not apply to Subtitle L.
4343 Sec. 112.103. CONTINUING EDUCATION COMPLIANCE REQUIRED FOR
4444 LICENSE RENEWAL. (a) Notwithstanding any other law, a licensing
4545 entity may not renew a health care practitioner's license unless
4646 the licensing entity verifies that the health care practitioner has
4747 complied with any continuing education requirements of the
4848 licensing entity.
4949 (b) Verification of a health care practitioner's compliance
5050 with continuing education requirements that the continuing
5151 education tracking system generates:
5252 (1) satisfies the requirement of Subsection (a); and
5353 (2) must be used in the conduct of any audit of health
5454 care practitioners the licensing entity conducts.
5555 (c) This section does not prohibit a licensing entity from
5656 imposing penalties under applicable statutes or rules for a health
5757 care practitioner's failure to comply with continuing education
5858 requirements.
5959 Sec. 112.104. CONTINUING EDUCATION TRACKING SYSTEM. (a)
6060 Each licensing entity by rule shall establish a continuing
6161 education tracking system for use by and accessible to health care
6262 practitioners, licensing entity staff, and continuing education
6363 providers.
6464 (b) A continuing education tracking system established
6565 under this subchapter may not require any licensing entity
6666 expenditure.
6767 Sec. 112.105. DATA AND SYSTEMS REQUIREMENTS. (a) A
6868 continuing education tracking system may collect and use only:
6969 (1) information that directly relates to a health care
7070 practitioner's compliance with continuing education requirements,
7171 including:
7272 (A) the name in which the health care
7373 practitioner's license is issued;
7474 (B) the health care practitioner's license
7575 number;
7676 (C) the license issue date;
7777 (D) the license expiration date; and
7878 (E) any other information disclosed to the public
7979 in response to a license verification request; and
8080 (2) other information the licensing entity designates
8181 by rule as necessary for the system's performance of a function
8282 required by this subchapter.
8383 (b) A continuing education tracking system established
8484 under Section 112.104 must:
8585 (1) if the continuing education tracking system is a
8686 cloud-based system, be certified under the state risk and
8787 authorization management program established under Section
8888 2054.0593, Government Code; and
8989 (2) comply with the Americans with Disabilities Act of
9090 1990 (42 U.S.C. Section 12101 et seq.).
9191 Sec. 112.106. RULEMAKING. A licensing entity shall adopt
9292 rules necessary to implement this subchapter.
9393 SECTION 3. Not later than September 1, 2026, each licensing
9494 entity shall establish a continuing education tracking system as
9595 required by Section 112.104, Occupations Code, as added by this
9696 Act.
9797 SECTION 4. Notwithstanding Section 112.104(b), Occupations
9898 Code, as added by this Act, a licensing entity subject to that
9999 section that on the effective date of this Act has an agreement in
100100 place with a continuing education tracking system provider that is
101101 able to implement the requirements of Subchapter C, Chapter 112,
102102 Occupations Code, as added by this Act, may maintain that agreement
103103 and any costs associated with implementation of the agreement.
104104 SECTION 5. This Act takes effect September 1, 2025.
