77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the sale of charitable raffle tickets by certain
1010 nonprofit wildlife conservation associations.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2002.054, Occupations Code, is amended
1313 by amending Subsection (a) and adding Subsection (a-1) to read as
1414 follows:
1515 (a) The organization may not:
1616 (1) directly or indirectly, by the use of paid
1717 advertising, promote a raffle through a medium of mass
1818 communication, including television, radio, or newspaper;
1919 (2) promote or advertise a raffle statewide, other
2020 than on the organization's Internet website or through a
2121 publication or solicitation, including a newsletter, social media,
2222 or electronic mail, provided only to previously identified
2323 supporters of the organization; or
2424 (3) sell or offer to sell tickets for a raffle
2525 statewide, except as provided by Subsection (a-1).
2626 (a-1) A nonprofit wildlife conservation association,
2727 including each local chapter, affiliate, wildlife cooperative, or
2828 unit, that for purposes of this chapter is a qualified nonprofit
2929 organization eligible under Section 2002.003(e), may use the
3030 organization's Internet website to sell or offer to sell tickets
3131 for a raffle to previously identified supporters of the
3232 organization. This subsection does not authorize the use of an
3333 Internet website to:
3434 (1) provide a graphic or dynamic animation of an entry
3535 to a raffle; or
3636 (2) provide a graphic or dynamic animation of the
3737 drawing of raffle tickets.
3838 SECTION 2. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2025.
