87 A BILL TO BE ENTITLED
98 AN ACT
109 relating to the disposition of certain surplus motor vehicles and
1110 other law enforcement equipment by the Texas Facilities Commission
1211 to certain school districts.
1312 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1413 SECTION 1. Section 2175.308, Government Code, is amended to
1514 read as follows:
1615 Sec. 2175.308. EXCEPTION FOR CERTAIN PROPERTY OF DEPARTMENT
1716 OF PUBLIC SAFETY. (a) Notwithstanding any conflicting provision
1817 of this chapter, if the commission determines that this state's
1918 efforts to secure this state's international border and combat
2019 transnational crime will sufficiently benefit from the donation of
2120 the surplus motor vehicles and other law enforcement equipment of
2221 the Department of Public Safety of the State of Texas to a municipal
2322 or county law enforcement agency, or to a school district, located
2423 in an economically disadvantaged area of this state, the commission
2524 may transfer the property to the agency or district at a price or
2625 for other consideration agreed to by the commission and the agency
2726 or district.
2827 (b) A law enforcement agency or school district that
2928 receives surplus property under Subsection (a) may not sell the
3029 property before the second anniversary of the date the property is
3130 received.
3231 SECTION 2. This Act takes effect September 1, 2025.
