| 13 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 13 | | SECTION 1. Section 2175.308, Government Code, is amended to |
|---|
| 15 | 14 | | read as follows: |
|---|
| 16 | 15 | | Sec. 2175.308. EXCEPTION FOR CERTAIN PROPERTY OF DEPARTMENT |
|---|
| 17 | 16 | | OF PUBLIC SAFETY. (a) Notwithstanding any conflicting provision |
|---|
| 18 | 17 | | of this chapter, if the commission determines that this state's |
|---|
| 19 | 18 | | efforts to secure this state's international border and combat |
|---|
| 20 | 19 | | transnational crime will sufficiently benefit from the donation of |
|---|
| 21 | 20 | | the surplus motor vehicles and other law enforcement equipment of |
|---|
| 22 | 21 | | the Department of Public Safety of the State of Texas to a municipal |
|---|
| 23 | 22 | | or county law enforcement agency, or to a school district, located |
|---|
| 24 | 23 | | in an economically disadvantaged area of this state, the commission |
|---|
| 25 | 24 | | may transfer the property to the agency or district at a price or |
|---|
| 26 | 25 | | for other consideration agreed to by the commission and the agency |
|---|
| 27 | 26 | | or district. |
|---|
| 28 | 27 | | (b) A law enforcement agency or school district that |
|---|
| 29 | 28 | | receives surplus property under Subsection (a) may not sell the |
|---|
| 30 | 29 | | property before the second anniversary of the date the property is |
|---|
| 31 | 30 | | received. |
|---|
| 32 | 31 | | SECTION 2. This Act takes effect September 1, 2025. |
