77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the deadline for an early voting ballot board to
1010 determine whether to accept voters' ballots.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 65.051(a), Election Code, is amended to
1313 read as follows:
1414 (a) The early voting ballot board shall verify and count
1515 provisional ballots as provided by this subchapter not later than
1616 the 10th [ninth] day after the date of an election.
1717 SECTION 2. Section 87.041, Election Code, is amended by
1818 adding Subsection (h) to read as follows:
1919 (h) The early voting ballot board shall determine whether to
2020 accept mail ballots as provided by this section not later than the
2121 10th day after the date of an election.
2222 SECTION 3. Section 87.0431(a), Election Code, is amended to
2323 read as follows:
2424 (a) Not later than the 10th day after the local canvass
2525 [election day], the presiding judge of the early voting ballot
2626 board shall deliver written notice of the reason for the rejection
2727 of a ballot to the voter at the residence address on the ballot
2828 application. If the ballot was transmitted to the voter by e-mail
2929 under Subchapter C, Chapter 101, the presiding judge shall also
3030 provide the notice to the e-mail address to which the ballot was
3131 sent.
3232 SECTION 4. This Act takes effect September 1, 2025.
