77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the minimum requirements for state employee positions.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle A, Title 6, Government Code, is amended
1212 by adding Chapter 621 to read as follows:
1313 CHAPTER 621. MINIMUM REQUIREMENTS FOR STATE EMPLOYEE POSITIONS
1414 Sec. 621.001. DEFINITIONS. In this chapter:
1515 (1) "Direct experience" means any verifiable,
1616 previous work experience in which:
1717 (A) the applicant's primary duties were
1818 consistent with the primary duties of the vacant position; or
1919 (B) the skills necessary to perform the
2020 applicant's primary duties are transferable to the vacant position.
2121 (2) "Minimum requirements" means the minimum skills,
2222 previous training, or previous experience necessary to perform the
2323 primary duties of a position of employment.
2424 (3) "State agency" has the meaning assigned by Section
2525 2052.101.
2626 Sec. 621.002. MINIMUM REQUIREMENTS. (a) Before seeking
2727 applicants for a vacant position, a state agency must determine the
2828 minimum requirements for the position, including:
2929 (1) direct experience relevant to the position; and
3030 (2) any certification or coursework required for the
3131 position.
3232 (b) A state agency may establish direct experience in a
3333 similar position as an alternative to a postsecondary degree for a
3434 minimum requirement for a position of employment.
3535 SECTION 2. (a) Chapter 621, Government Code, as added by
3636 this Act, applies only to an application submitted for a vacant
3737 state employee position on or after the effective date of this Act.
3838 An application submitted before the effective date of this Act is
3939 governed by the law in effect on the date the application was
4040 submitted, and the former law is continued in effect for that
4141 purpose.
4242 (b) A state agency subject to Chapter 621, Government Code,
4343 as added by this Act, shall determine the minimum requirements for
4444 each vacant position the agency seeks to fill on or after the
4545 effective date of this Act.
4646 SECTION 3. This Act takes effect September 1, 2025.
