| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subtitle A, Title 6, Government Code, is amended |
|---|
| 12 | 12 | | by adding Chapter 621 to read as follows: |
|---|
| 13 | 13 | | CHAPTER 621. MINIMUM REQUIREMENTS FOR STATE EMPLOYEE POSITIONS |
|---|
| 14 | 14 | | Sec. 621.001. DEFINITIONS. In this chapter: |
|---|
| 15 | 15 | | (1) "Direct experience" means any verifiable, |
|---|
| 16 | 16 | | previous work experience in which: |
|---|
| 17 | 17 | | (A) the applicant's primary duties were |
|---|
| 18 | 18 | | consistent with the primary duties of the vacant position; or |
|---|
| 19 | 19 | | (B) the skills necessary to perform the |
|---|
| 20 | 20 | | applicant's primary duties are transferable to the vacant position. |
|---|
| 21 | 21 | | (2) "Minimum requirements" means the minimum skills, |
|---|
| 22 | 22 | | previous training, or previous experience necessary to perform the |
|---|
| 23 | 23 | | primary duties of a position of employment. |
|---|
| 24 | 24 | | (3) "State agency" has the meaning assigned by Section |
|---|
| 25 | 25 | | 2052.101. |
|---|
| 26 | 26 | | Sec. 621.002. MINIMUM REQUIREMENTS. (a) Before seeking |
|---|
| 27 | 27 | | applicants for a vacant position, a state agency must determine the |
|---|
| 28 | 28 | | minimum requirements for the position, including: |
|---|
| 29 | 29 | | (1) direct experience relevant to the position; and |
|---|
| 30 | 30 | | (2) any certification or coursework required for the |
|---|
| 31 | 31 | | position. |
|---|
| 32 | 32 | | (b) A state agency may establish direct experience in a |
|---|
| 33 | 33 | | similar position as an alternative to a postsecondary degree for a |
|---|
| 34 | 34 | | minimum requirement for a position of employment. |
|---|
| 35 | 35 | | SECTION 2. (a) Chapter 621, Government Code, as added by |
|---|
| 36 | 36 | | this Act, applies only to an application submitted for a vacant |
|---|
| 37 | 37 | | state employee position on or after the effective date of this Act. |
|---|
| 38 | 38 | | An application submitted before the effective date of this Act is |
|---|
| 39 | 39 | | governed by the law in effect on the date the application was |
|---|
| 40 | 40 | | submitted, and the former law is continued in effect for that |
|---|
| 41 | 41 | | purpose. |
|---|
| 42 | 42 | | (b) A state agency subject to Chapter 621, Government Code, |
|---|
| 43 | 43 | | as added by this Act, shall determine the minimum requirements for |
|---|
| 44 | 44 | | each vacant position the agency seeks to fill on or after the |
|---|
| 45 | 45 | | effective date of this Act. |
|---|
| 46 | 46 | | SECTION 3. This Act takes effect September 1, 2025. |
