65 A BILL TO BE ENTITLED
76 AN ACT
87 relating to the state law enforcement authority of federal National
98 Park Service law enforcement officers.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Article 2A.002, Code of Criminal Procedure, is
1211 amended by amending Subsection (d) and adding Subsection (d-1) to
1312 read as follows:
1413 (d) A commissioned law enforcement officer of the National
1514 Park Service is not a peace officer under the laws of this state but
1615 has:
1716 (1) the powers of arrest, search, and seizure as to any
1817 offense under the laws of this state committed in a national park or
19- national recreation area; and
20- (2) within the boundaries of a national park or
21- national recreation area:
22- (A) the power to execute any arrest warrant or
23- search warrant issued under the laws of this state; and
24- (B) the powers granted to a peace officer by
25- Chapters 573 and 574, Health and Safety Code.

2623 (d-1) For purposes of Subsection (d) [In this subsection],
2724 "national park or national recreation area" means a national park
2825 or national recreation area included in the National Park System as
2926 defined by 54 U.S.C. Section 100102.
3027 SECTION 2. This Act takes effect immediately if it receives
3128 a vote of two-thirds of all the members elected to each house, as
3229 provided by Section 39, Article III, Texas Constitution. If this
3330 Act does not receive the vote necessary for immediate effect, this
3431 Act takes effect September 1, 2025.
