77 AN ACT
88 relating to an alternate board certification to signify
99 accreditation within a given specialty in this state and medical
1010 care provided at certain health care facilities by physicians with
1111 an alternate board certification.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 222, Health and Safety Code, is amended
1414 by adding Subchapter D to read as follows:
1515 SUBCHAPTER D. MEDICAL CARE PROVIDED BY PHYSICIANS WITH ALTERNATE
1616 BOARD CERTIFICATIONS AT CERTAIN HEALTH CARE FACILITIES
1717 Sec. 222.101. DEFINITIONS. In this chapter:
1818 (1) "Commission" means the Health and Human Services
1919 Commission.
2020 (2) "Executive commissioner" means the executive
2121 commissioner of the commission.
2222 (3) "Health care facility" means a health care facility
2323 licensed by the commission.
2424 Sec. 222.102. MEDICAL CARE PROVIDED BY PHYSICIANS WITH
2525 ALTERNATE BOARD CERTIFICATION TO PRACTICE MEDICINE; FACILITY
2626 LICENSE REVOCATION. (a) A health care facility may not refuse to
2727 accept for board certification purposes a physician's alternate
2828 board certification to practice medicine issued under Section
2929 155.012, Occupations Code, in employing or granting practice or
3030 admitting privileges to the physician for providing medical care to
3131 patients at the facility or otherwise discriminate against the
3232 physician in making an employment or privilege decision based on
3333 the physician's alternate board certification.
3434 (b) The commission shall revoke the license of a
3535 health care facility that violates this section.
3636 (c) The executive commissioner shall adopt rules to
3737 implement this section.
3838 SECTION 2. Subchapter A, Chapter 155, Occupations Code, is
3939 amended by adding Section 155.012 to read as follows:
4040 Sec. 155.012. ALTERNATE BOARD CERTIFICATION FOR CERTAIN
4141 APPLICANTS. (a) The board shall allow alternate board
4242 certifications to practice medicine in this state that:
4343 (1) requires an applicant to satisfy each applicable
4444 eligibility requirement for a board certification under this
4545 chapter except as provided by Subdivision (2); and
4646 (2) does not require an applicant to complete courses
4747 or training on or to satisfy any other requirement, including
4848 obtaining certification, for:
4949 (a) providing a medical treatment or procedure
5050 that is unlawful in the State of Texas.
5151 (b) The board shall adopt rules to implement this section.
5252 SECTION 3. As soon as practicable after the effective date
5353 of this Act:
5454 (1) the executive commissioner of the Health and Human
5555 Services Commission shall adopt the rules necessary to implement
5656 Subchapter D, Chapter 222, Health and Safety Code, as added by this
5757 Act; and
5858 (2) the Texas Medical Board shall adopt rules to
5959 implement the alternate board certification to signify
6060 accreditation within a given specialty in this state as required by
6161 Section 155.012, Occupations Code, as added by this Act.
6262 SECTION 4. This Act takes effect September 1, 2025.
