77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the receipt of financial benefits by the superintendent
1010 of a school district for certain services performed by the
1111 superintendent.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 11.201, Education Code, is amended by
1414 amending Subsection (e) and adding Subsections (f) and (g) to read
1515 as follows:
1616 (e) The superintendent of a school district may not receive
1717 any financial benefit for personal services performed by the
1818 superintendent for:
1919 (1) any business entity that conducts or solicits
2020 business with the district;
2121 (2) an education business that provides services
2222 regarding the curriculum or administration of any school district;
2323 or
2424 (3) another school district.
2525 (f) Any financial benefit received by the superintendent
2626 for performing personal services for any [other] entity not
2727 described by Subsection (e), including an [a school district,]
2828 open-enrollment charter school, regional education service center,
2929 or public or private institution of higher education, must be
3030 approved by the board of trustees on a case-by-case basis in an open
3131 meeting.
3232 (g) For purposes of Subsections (e) and (f) [this
3333 subsection], the receipt of reimbursement for a reasonable expense
3434 is not considered a financial benefit.
3535 SECTION 2. Section 11.201, Education Code, as amended by
3636 this Act, applies only to a financial benefit received by the
3737 superintendent of a school district on or after the effective date
3838 of this Act.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2025.
