88 AN ACT
99 relating to the establishment of the sickle cell disease registry.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
1212 amended by adding Chapter 52B to read as follows:
1313 CHAPTER 52B. SICKLE CELL DISEASE REGISTRY
1414 Sec. 52B.001. DEFINITION. In this chapter, "health care
1515 facility" means:
1616 (1) a hospital licensed under Chapter 241; or
1717 (2) any other facility that provides diagnostic or
1818 treatment services to patients with sickle cell disease.
1919 Sec. 52B.002. REGISTRY; CONTENTS. (a) The department shall
2020 establish and maintain a sickle cell disease registry in accordance
2121 with this chapter for use as a single repository of accurate,
2222 complete records of sickle cell disease cases to aid in the cure and
2323 treatment of sickle cell disease in this state.
2424 (b) The sickle cell disease registry must include:
2525 (1) a record of sickle cell disease cases that occur in
2626 this state; and
2727 (2) any other information concerning sickle cell
2828 disease cases the executive commissioner considers necessary and
2929 appropriate to assist with the cure or treatment of sickle cell
3030 disease.
3131 Sec. 52B.003. DATA FROM HEALTH CARE FACILITIES. A health
3232 care facility shall provide to the department, in the form and
3333 manner the department prescribes, data the department considers
3434 necessary and appropriate concerning sickle cell disease cases.
3535 Sec. 52B.004. DEPARTMENT POWERS; RULES. (a) To implement
3636 this chapter, the department may:
3737 (1) execute necessary contracts;
3838 (2) receive data from health care facilities
3939 concerning sickle cell disease cases to record and analyze the data
4040 directly related to the disease; and
4141 (3) compile and publish statistical and other studies
4242 derived from data obtained under this chapter to provide, in an
4343 accessible form, information useful to physicians, other medical
4444 personnel, and the public.
4545 (b) The executive commissioner shall adopt rules to
4646 implement this chapter.
4747 (c) The executive commissioner by rule shall develop
4848 guidelines to:
4949 (1) obtain data from health care facilities regarding
5050 sickle cell disease cases;
5151 (2) protect the confidentiality of individuals
5252 diagnosed with sickle cell disease in accordance with Section
5353 159.002, Occupations Code; and
5454 (3) ensure the registry is developed in a manner
5555 consistent with:
5656 (A) the Health Insurance Portability and
5757 Accountability Act of 1996 (Pub. L. No. 104-191) and regulations
5858 adopted under that Act; and
5959 (B) other applicable laws and regulations
6060 governing disclosure of health information.
6161 Sec. 52B.005. REPORTS. (a) The department shall submit an
6262 annual report to the legislature on the information obtained under
6363 this chapter.
6464 (b) The department, in cooperation with other sickle cell
6565 disease reporting organizations and research institutions, may
6666 publish reports the department determines are necessary to carry
6767 out the purposes of this chapter.
6868 SECTION 2. As soon as practicable after the effective date
6969 of this Act, the executive commissioner of the Health and Human
7070 Services Commission shall adopt rules necessary to implement
7171 Chapter 52B, Health and Safety Code, as added by this Act.
7272 SECTION 3. This Act takes effect September 1, 2025.
