8	8	AN ACT
9	9	relating to the establishment of the sickle cell disease registry.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subtitle B, Title 2, Health and Safety Code, is
12	12	amended by adding Chapter 52B to read as follows:
13	13	CHAPTER 52B. SICKLE CELL DISEASE REGISTRY
14	14	Sec. 52B.001. DEFINITION. In this chapter, "health care
15	15	facility" means:
16	16	(1) a hospital licensed under Chapter 241; or
17	17	(2) any other facility that provides diagnostic or
18	18	treatment services to patients with sickle cell disease.
19	19	Sec. 52B.002. REGISTRY; CONTENTS. (a) The department shall
20	20	establish and maintain a sickle cell disease registry in accordance
21	21	with this chapter for use as a single repository of accurate,
22	22	complete records of sickle cell disease cases to aid in the cure and
23	23	treatment of sickle cell disease in this state.
24	24	(b) The sickle cell disease registry must include:
25	25	(1) a record of sickle cell disease cases that occur in
26	26	this state; and
27	27	(2) any other information concerning sickle cell
28	28	disease cases the executive commissioner considers necessary and
29	29	appropriate to assist with the cure or treatment of sickle cell
30	30	disease.
31	31	Sec. 52B.003. DATA FROM HEALTH CARE FACILITIES. A health
32	32	care facility shall provide to the department, in the form and
33	33	manner the department prescribes, data the department considers
34	34	necessary and appropriate concerning sickle cell disease cases.
35	35	Sec. 52B.004. DEPARTMENT POWERS; RULES. (a) To implement
36	36	this chapter, the department may:
37	37	(1) execute necessary contracts;
38	38	(2) receive data from health care facilities
39	39	concerning sickle cell disease cases to record and analyze the data
40	40	directly related to the disease; and
41	41	(3) compile and publish statistical and other studies
42	42	derived from data obtained under this chapter to provide, in an
43	43	accessible form, information useful to physicians, other medical
44	44	personnel, and the public.
45	45	(b) The executive commissioner shall adopt rules to
46	46	implement this chapter.
47	47	(c) The executive commissioner by rule shall develop
48	48	guidelines to:
49	49	(1) obtain data from health care facilities regarding
50	50	sickle cell disease cases;
51	51	(2) protect the confidentiality of individuals
52	52	diagnosed with sickle cell disease in accordance with Section
53	53	159.002, Occupations Code; and
54	54	(3) ensure the registry is developed in a manner
55	55	consistent with:
56	56	(A) the Health Insurance Portability and
57	57	Accountability Act of 1996 (Pub. L. No. 104-191) and regulations
58	58	adopted under that Act; and
59	59	(B) other applicable laws and regulations
60	60	governing disclosure of health information.
61	61	Sec. 52B.005. REPORTS. (a) The department shall submit an
62	62	annual report to the legislature on the information obtained under
63	63	this chapter.
64	64	(b) The department, in cooperation with other sickle cell
65	65	disease reporting organizations and research institutions, may
66	66	publish reports the department determines are necessary to carry
67	67	out the purposes of this chapter.
68	68	SECTION 2. As soon as practicable after the effective date
69	69	of this Act, the executive commissioner of the Health and Human
70	70	Services Commission shall adopt rules necessary to implement
71	71	Chapter 52B, Health and Safety Code, as added by this Act.
72	72	SECTION 3. This Act takes effect September 1, 2025.
