11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter B, Chapter 43, Election Code, is | |
13 | 13 | amended by adding Section 43.035 to read as follows: | |
14 | 14 | Sec. 43.035. RESTROOM FACILITY IN POLLING PLACE. (a) A | |
15 | 15 | polling place must provide an accessible restroom to voters, | |
16 | 16 | election workers, and volunteers during the hours the polling place | |
17 | 17 | is open for voting. The polling place must maintain visible signage | |
18 | 18 | to indicate the location of the restroom. | |
19 | 19 | (b) If a polling place does not maintain a permanent | |
20 | 20 | restroom facility accessible to the public, the county or political | |
21 | 21 | subdivision responsible for the polling place shall provide a | |
22 | 22 | temporary restroom, in compliance with the Americans with | |
23 | 23 | Disabilities Act of 1990 (42 U.S.C. Section 12131 et seq.), that is | |
24 | 24 | readily accessible by a voter at the polling place. | |
25 | 25 | (c) Election materials distributed at a polling place must | |
26 | 26 | include information about restroom access. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
