57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to an exemption from boiler registration and inspection
810 requirements for certain boilers in medical equipment and
911 autoclaves.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 755.022(a), Health and Safety Code, is
1214 amended to read as follows:
1315 (a) This chapter does not apply to:
1416 (1) boilers owned or operated by the federal
1517 government;
1618 (2) pressure vessels or process steam generators,
1719 other than steam collection or liberation drums of process steam
1820 generators;
1921 (3) manually fired miniature boilers that:
2022 (A) are constructed or maintained for
2123 locomotives, boats, tractors, or stationary engines only as a hobby
2224 for exhibition, recreation, education, or historical purposes and
2325 not for commercial use;
2426 (B) have an inside diameter of 12 inches or less
2527 or a grate area of two square feet or less; and
2628 (C) are equipped with a safety valve of adequate
2729 size, a water level indicator, and a pressure gauge;
2830 (4) boilers that are designed for operation only at
2931 atmospheric pressure and that are equipped with two independent
3032 means to prevent the buildup of pressure;
3133 (5) steam cookers; [or]
3234 (6) espresso machines;
3335 (7) boilers that are a component of a medical device
3436 regulated by the United States Food and Drug Administration and are
3537 of a size that does not exceed:
3638 (A) an inside shell diameter of 16 inches;
3739 (B) 20 square feet of heating surface, unless the
3840 boiler is electric;
3941 (C) five cubic feet of gross volume, excluding
4042 the casing and insulation; and
4143 (D) an allowable working pressure of 100 pounds
4244 per square inch gauge; or
4345 (8) unfired pressure vessels in an autoclave.
4446 SECTION 2. This Act takes effect September 1, 2025.
