| 9 | 9 | | relating to the improvement of certain school campuses based on the |

| 10 | 10 | | construction or rehabilitation of certain low income housing |
|---|
| 11 | 11 | | developments in the attendance zone of those campuses. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Chapter 380, Local Government Code, is amended |
|---|
| 14 | 14 | | by adding Section 380.005 to read as follows: |
|---|
| 15 | 15 | | Sec. 380.005. REQUIRED MUNICIPAL FUNDING OF CERTAIN CAPITAL |
|---|
| 16 | 16 | | IMPROVEMENTS. (a) In this section, "development" has the meaning |
|---|
| 17 | 17 | | assigned by Section 2306.6702, Government Code. |
|---|
| 18 | 18 | | (b) This section applies only to land that is: |
|---|
| 19 | 19 | | (1) located in a county with a population of more than |
|---|
| 20 | 20 | | 1.5 million and in which more than 75 percent of the population |
|---|
| 21 | 21 | | lives in a single municipality; and |
|---|
| 22 | 22 | | (2) annexed by a municipality under Chapter 43. |
|---|
| 23 | 23 | | (c) A municipality in which a development is being |
|---|
| 24 | 24 | | constructed or rehabilitated on land to which this section applies |
|---|
| 25 | 25 | | shall request from each independent school district with a campus |
|---|
| 26 | 26 | | whose attendance zone includes the development an impact study that |
|---|
| 27 | 27 | | evaluates the capital improvements necessary for the campus to |
|---|
| 28 | 28 | | reasonably accommodate the estimated increase in the number of |
|---|
| 29 | 29 | | students that will result from the development. |
|---|
| 30 | 30 | | (d) Notwithstanding any other law and based on the results |
|---|
| 31 | 31 | | of the impact study a municipality requests under Subsection (c), |
|---|
| 32 | 32 | | the municipality shall fund the capital improvements identified as |
|---|
| 33 | 33 | | necessary in that study. The capital improvements must be |
|---|
| 34 | 34 | | completed in the manner and based on the timeline agreed on by the |
|---|
| 35 | 35 | | municipality and independent school district. |
|---|
| 36 | 36 | | SECTION 2. Section 380.005, Local Government Code, as added |
|---|
| 37 | 37 | | by this Act, applies to the construction or rehabilitation of a |
|---|
| 38 | 38 | | development that is in progress on or after the effective date of |
|---|
| 39 | 39 | | this Act. |

| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2025. |
